Background:
The Governance Sections (GS) 2024 project Promoting Quality in Public Processes III will continue to support the Information and Privacy Agency (IPA) in promoting the right to access public documents and the protection of personal data. The GS has been supporting the IPA in strengthening its internal professional capacities through building the legal infrastructure foreseen by the Law on Access to Public Documents and Protection of Personal Data as well as advising its staff around these areas.
Both laws are complex and introductory to the new concepts concerning these rights. Therefor there is a need to further support IPAs staff in enhancing their professional capacities to better oversee implementation of these laws with an ultimate goal of safeguarding resident right to data-access and privacy protection. To this end, the GS will hire a local legal expert to support the IPA in strengthening professional capacities of its staff and improve and complement its policy and legal framework.
The present Special Service Agreement (SSA) concerns further support in this direction that will enable the IPA to design strategies and concept documents on transparency and privacy protection areas, creating directive, strategic tools for overseeing implementation of the respective laws.
The expert will work closely with the Commissioner and IPAs General Director.
Objective of Assignment:
Supporting the IPA in increasing its internal professional capacities and advising its staff in matters concerning implementation of the laws on access to public documents and the protection of personal data.
Duration of Assignment
The Consultant will be hired for 40 working days.
Tasks and Responsibilities:
The local legal expert will report to the Governance Section (GS) Activity Manager and work closely with other members of the GS team and will be tasked to:
a) Prepare the concept for the development of IPA’s transparency plan;
b) Prepare the Guideline on the Damage and Interest Test implementing Article 18 of the Law on Access to Public Documents;
c) Prepare the concept of sub-legal acts for access to public documents and the protection of personal data;
d) Prepare a draft final report on the performed tasks and submit to the GS Project Manager for review.
Deliverables:
- Submit the draft concept for the development of the transparency plan by end of April;
- Submit the draft Guideline on the Damage and Interest Test by end of May;
- Submit the draft concept of sub-legal acts for access to public documents and the protection of personal data by end of June;
- Submit the Final Report including gender-desegregated data applicable, the latest by end of August.
Performance Indicators:
- The concept document for the development of the transparency plan drafted and accepted by IPA;
- The Guideline on the Damage and Interest Test drafted and accepted by IPA;
- The concept of sub-legal acts for access to public documents and the protection of personal data drafted and accepted by IPA;
- Effective and efficient communication with the GS team and with officials from the IPA;
- Participation and co-facilitation of the working group/meetings during the activity implementation;
- Advising of the IPA on matters pertaining the implementation of the laws on access to public documents and protection of personal data;
- Flexible on possible new instructions to be taken into consideration which may derive from the GS team through his/her assignment;
- Timely and qualitative submission of all the deliverables and other products that are foreseen within this ToR, or new tasks that might be agreed upon during the implementation of the works.
Necessary Qualifications:
- University degree in law, or a related discipline;
- At least five (5) years of relevant professional experience, preferably in drafting legal acts and guidelines;
- Specific knowledge of the legislation on the access to public documents and privacy protection is an asset;
- Knowledge of the General Data Privacy Regulation (GDPR) is an asset;
- Excellent organizational skills with capacity to deal effectively with changing priorities;
- Command of Windows software, Microsoft Office and Microsoft Outlook;
- Ability to keep strict deadlines and deal with several activities simultaneously;
- Fluent in Albanian and English, knowledge of Serbian is an asset.
