Term of Reference: Forced Eviction Monitoring and Response Mechanism

Introduction and background

Since 2012, NRC introduced Information, Counseling and Legal Assistance (ICLA) programme. The ICLA programme primarily work on aspects of Housing, Land and Property rights for IDPs and other people affected by displacement.  Since then, the ICLA programme in Somaliland and Puntland extended and consolidated the HLP (Housing, Land and Property) programme. Besides providing Information, counselling and legal assistance to beneficiaries, the programme provided an appropriate space for relevant stakeholders (Humanitarians Organizations, governmental institutions, people affected by displacement and local communities) to discuss land issues. That space was materialized by the establishment of the HLP Working Group in Puntland, mainly composed of Shelter and Protection Cluster members.

One of the lessons learnt during ICLA programme implementation is that ICLA activities, especially legal counselling and assistance to beneficiaries against forced eviction need more presence in IDPs settlements. For forced evictions cases for example, it is difficult to resolve or prevent them as usually, ICLA teams are aware of them when it is too late. This also mentioned in the recent research on land disputes and resolution mechanisms in Puntland that was conducted end 2014 and finalized March 2015.

“The study found that although a wide range of local dispute resolution avenues existed – namely municipal authorities, customary courts, sharia law, statutory courts and NGO initiated collaborative dispute resolution services – these were largely unable to prevent evictions[1]. These institutions and mechanisms were ineffective in preventing evictions because IDPs were frequently not given any notice period and evicted with immediate effect.”

One of the recommendations from the research was the establishment of the rapid response mechanisms at field level which out of reach 24/7, so that families facing imminent eviction can immediately contact support.

It is in order to respond to that need that ICLA programme initiated a “forced eviction monitoring network” composed of paralegal from IDPs and host communities, permanently based on field with a 24/7 link to ICLA team via mobile phone. Those paralegals role will in the first time to alert ICLA teams when an eviction is about to happen. Meanwhile, they will be receiving training on CDR and HLP so that in the future, they can initiate land conflicts resolution while waiting more support from NRC.  

 

The purpose and scope of the “forced eviction monitoring network”

The purpose of the network is to timely provide information and assistance to beneficiaries facing forced eviction or other ICLA related problem.

The network is composed of paralegals chosen amongst the IDPs community as well as host community.

Main tasks of paralegals

The main role of the paralegal is to support the ICLA programme on legal assistance aspects as well as the trace and reports on the case that relates to forced evictions and HLP issue toward ICLA staff.

The following are the main of the duties the paralegal will have to fulfill:

  1. Monitor and collect field level information on risk of eviction or ongoing eviction on daily basis in designed IDPs settlements according to a coordinated plan with his colleagues, and report to NRC ICLA team.
  2. Monitor and collect information on Housing, Land and Property disputes and report to NRC ICLA teams, and if necessary initiate first steps towards collaborative disputes resolution.
  3. Mobilize community and participate in all ICLA activities ( information session, legal counseling,legal assistance and training) and support ICLA staff field level related issues
  4. Occupy on daily basis (with a shifting mechanism to be agreed on with his colleagues) the ICLA listening centre and collect urgent cases and link up with ICLA team. If cases are not urgent, inform beneficiaries on when the ICLA team will be at the centre.
  5. Ensure proper functionality of the centre on daily basis and maintain its security, safety and cleanliness.
  6. Conducted other jobs that NRC assigns in field level.

Qualification and experience

  • Secondary education
  • Law, custom and sharia knowledge will be advantage
  • Writings and reading skills both Somali and English
  • At least 3 years of experience in working with IDP community and know the context well.
  • Good communication skills
  • Experience in community mobilization/leadership
  • Experience working with IDPs and refugees
