Based in Seoul, The Global Green Growth Institute (GGGI) is an intergovernmental organization founded to support and promote a model of economic growth known as "green growth", which targets key aspects of economic performance such a poverty reduction, job creation, social inclusion, and environmental sustainability. GGGI works with countries around the world, building their capacity and working collaboratively on green growth policies that can impact the lives of millions. The organization partners with countries, multilateral institutions, government bodies, and private sector to help build economies that grow strongly and are more efficient and sustainable in the use of natural resources, less carbon intensive, and more resilient to climate change.

 GGGI supports stakeholders through complementary and integrated workstreams – Green Growth Planning & Implementation and Knowledge Solutions – that deliver comprehensive products designed to assist in developing, financing, and mainstreaming green growth in national economic development plans.

 Green Growth Planning and Implementation (GGP&I) is the in-country delivery mechanism for GGGI. It supports partner countries to achieve development priorities through evidence based green growth planning and implementation. 

Recently, at the request of the Hungarian Government, GGGI is in the process of establishing a regional climate change fund as a pooled mechanism to streamline allocation, programming, disbursement, and monitoring climate finance. In order establish and operationalize the fund, a Legal Adviser position is being established.

Objectives/Purpose of the Assignment:

 

Reporting to the Senior adviser position on strengthening green growth and climate funds, Green Growth Planning and Implementation (GGP&I) Division, the Legal Adviser will assist in the preparation of all legal documents and ensure they are coherent with best practice and the legal framework of the regional fund.

 

The role of Legal Adviser is to ensure legal advice on the interpretation of statutes, decrees and other legal documents; provide legal advice for design and operationalization of the fund; and advise on litigation risk, policies and procedures, contribution matters, intellectual property, and governance questions.

 

Scope of Work:

 

  • Assist in the review and preparation of all legal documents required for the design of the fund;
  • Ensure the fund design document is coherent with best practice and the legal framework of Hungary;
  • Provide legal support on matters related to fund’s operationalization
  • Provide legal advice, draft and advise on memoranda of understanding for seed capitalization;
  • Conduct and review due diligence about the fund’s operations on proposed funding structures;
  • Assist in developing internal controls and procedures for the various activities of the fund Assist in drafting and negotiating final design document.
  • Coordinate and lead in providing legal advice and support relating to fund’s functional, institutional and administrative matters;
  • Lead fund’s efforts to enter multi- or bilateral agreements with potential funders for seed capitalization; Assist in drafting and reviewing legal documents related to the Fund design;
  •  Keep abreast of Hungarian legal field especially in relation to public law relating to administrative, institutional or governance matters which might affect the fund and prepare reports on relevant issues

Output/Reporting Requirements/Deliverables:

 

  • Provide legal advices 1) governance, 2) utilization, 3) capitalization, and 4) oversight of the fund and other relevant design matters
  • Ensure the most “most relevant scenario” including a very clear roadmap on financial, institutional and technical aspects, is compliant with legal rules, laws and decrees Hungary
  • Advise on procurement, finance and contracts rules and procedures
  • Draft legal texts relevant for submission of the fund design parliamentary processes
  • Provide advice on resource mobilization and agreements

Qualifications/Experience/Expertise

 

QUALIFICATIONS

 

Minimum:

  • Juris Doctor, or equivalent law degree;
  • Minimum of four years of relevant professional experience, of which at least two years public administration;
  • Strong professional knowledge of the Hungarian legal system;
  • Fluency in English and Hungarian is essential.

 

Preferred:

 

  • additional LLM degree is a plus;
  • bar exam is an advantage;
  • Strong professional knowledge of and relevant practitioner experience in climate finance;
  • Experience in working with EU regional/ESIF and/or enlargement policy will be an advantage;
  • Experience with international private law is an asset.
