Background

UN Women, grounded in the vision of equality enshrined in the Charter of the United Nations, works for the elimination of discrimination against women and girls; the empowerment of women; and the achievement of equality between women and men as partners and beneficiaries of development, human rights, humanitarian action and peace and security.

Ukraine has a policy and legislative framework on gender equality, and gender equality is enshrined in the Constitution. The government implements the National Programme on Equal Rights and Opportunities of Women and Men (2017-2020), in addition to the Law on Equal Opportunities, the Law on Domestic Violence and the National Strategy and Action Plan on Human Rights (2015-2020). In response to the conflict, the Government adopted a National Action Plan for Implementation of the UNSCR 1325 (2016-2020). The country has also adopted the Sustainable Development Goals (SDGs), the Beijing Declaration and the Platform for Action (BPfA) and ratified the main international human rights instruments.

Ukraine also ratified the Convention on Elimination of All Forms of Discrimination against Women (CEDAW) (1981) and its Optional Protocol (2003). Nevertheless, the CEDAW Committee’s Concluding Observations (2010 and 2017), the 20-year Review of the Beijing Platform for Action in 2010 (Beijing+15), and the report on the achievements of the Millennium Development Goals (MDGs) all stress that Ukraine needs to improve its implementation of CEDAW in order to make gender equality a reality. Among the key challenges are low awareness on the part of the duty bearers and rights holders about the Convention, weak capacity of state officials and judiciary actors to apply the Convention in practice, weak oversight and coordination of implementation of the Convention and insufficient investments in empowerment of women facing discrimination, including multiple discrimination.

The CEDAW Committee, in its Concluding Observations of the Eighth Periodic Report of Ukraine (March 2017), noted with appreciation the adoption of plans of action and strategies on equality, as well as the Prime Minister’s decision to establish the position of Commissioner on Equal Rights and Opportunities for Women and Men in the Cabinet of Ministers. However, the Committee expressed concern that there is no reference to gender equality in the ongoing reforms with regards to decentralization and that the administrative reform of 2010 and the related restructuring has weakened the national machinery for the advancement of women, resulting in a lack of continuity in gender equality policies. It is also concerned at the limited capacity of the national machinery to adequately ensure the coordination of gender mainstreaming in all areas and at all levels.

The Committee recommended that the Government: adopt a clear strategy to consolidate and reinforce the national and local capacity of the national machinery for the advancement of women and ensure that it has adequate decision-making power and human and financial resources to effectively implement the Convention and that it works in a decentralized manner for the promotion of women’s human rights at all levels; ensure effective coordination and develop a gender mainstreaming strategy that includes gender-responsive budgeting and that can be applied in all policies and programmes at all levels with regard to various aspects of women’s lives; ensure that its national machinery develop policies and programmes aiming at achieving gender equality in a comprehensive and effective manner and within a human rights framework, and improve the collection of the data, disaggregated by sex and other relevant factors, necessary to assess the impact and effectiveness of those policies and programmes.

The Government is focused on implementing the CEDAW Concluding Observations. On 1 March 2017, the Cabinet of Ministers adopted a decree assigning the Vice Prime Minister on EU and Euro-Atlantic Integration with the functions and responsibilities for coordination of the state gender equality policy. In June, the Cabinet of Ministers established the position of the Commissioner on Equal Rights and Opportunities of Women and Men with a respective unit.  

To further support the Government with CEDAW implementation, UN Women launched the project “CEDAW in Action!” in June 2017, which is funded by the Government of Canada. The project aims to promote stronger national accountability processes and mechanisms to facilitate CEDAW implementation. One objective of the project will be to support the national machinery on gender equality to develop a strategy for effective CEDAW implementation, monitoring and reporting. This will be achieved, in part, through the provision of technical and institutional-building support to the Office of the Vice-Prime-Minister on European and Euro-Atlantic Integration in development of the strategy and mechanism for dissemination, implementation, monitoring and reporting on the CEDAW and its Concluding Observations. Proposals for strengthening existing structures/establishing new structures that are mandated to assess policies and legislation for CEDAW compliance and to ensure an integrated approach to implementation of other international and national commitments, state policies and programmes on gender equality will be provided.

Therefore, UN Women seeks to hire the National Consultant to provide institutional building and technical support to the Government of Ukraine to strengthen the existing structures and create a coordination and monitoring mechanism to ensure stronger accountability for the obligations under CEDAW and effective implementation of the Concluding Observations (85 working days).

Duties and Responsibilities

Under the overall guidance of the UN Women Country Programme Manager, technical guidance by the CEDAW Project Analyst and day-to-day supervision of the Vice-Prime Minister on EU and Euro-Atlantic Integration, the consultant will implement a set of tasks, including, but not limited to: 

Technical support to the Office of the Vice-Prime Minister on EU and Euro-Atlantic Integration and key national gender institutions to develop a strategy and mechanism for implementation, monitoring and reporting on CEDAW and the Concluding Observations

  • Conduct desk research of international best practices of government-wide coordination, implementation, monitoring and accountability systems for CEDAW and follow-up mechanisms on Concluding Observations;

  • Conduct an analysis of existing structures, institutions and mechanisms relevant for monitoring and implementing and reporting on CEDAW; assess the gaps and the potential for establishing new structures and mechanisms to improve Government accountability for CEDAW commitments;

  • Organize multi-stakeholder and inter-ministerial consultations to jointly analyze gaps and needs to strengthen CEDAW implementation;

  • Providee a set of recommendations and a proposed strategy and mechanism for improved dissemination, implementation, monitoring and reporting on CEDAW and the Concluding Observations
  • Coordinate and organize inter-ministerial learning workshops on best practices and tools for CEDAW implementation, monitoring and reporting;
  • Provide day-to-day advisory and capacity-building support to the Office of the Vice-Prime Minister on EU and Euro-Atlantic Integration and other key national gender institutions, including on-job trainings, and support for the development and implementation of a coordination mechanism for enhanced CEDAW implementation, monitoring and reporting

  • All reports, events supporting documents, including the drafted action plans, tools and training materials, should be submitted in Ukrainian language.

  • The Consultant is expected to work remotely using her/his own computer, but may access the UN Women office for printing of relevant documents or should he/she be required to work on-site at any point during the assignment.

Performance evaluation:

  • Contractor’s performance will be evaluated against such criteria as: timeliness, responsibility, initiative, communication, accuracy, and quality of the products delivered. The evaluation will be carried out and cleared by the hiring manager which will also be the basis for payment on a delivery by delivery basis to the consultant.

Financial arrangements:  

  • Payment will be disbursed by instalments according to the above schedule of deliverables upon receipt of the progress reports and their certification by the UN Women Gender Advisor that the services have been satisfactorily performed.

Required Skills and Experience

Qualifications Education:

Advanced (Masters) degree in Human Rights, Political Science, Gender Studies, Social Sciences or related field.

Experience:

  • At least 5 years of relevant work experience in human rights, gender, development or other relevant field;
  • Proven experience conducting institutional analysis, development of human rights monitoring mechanisms, provision of capacity building for government officials;
  • Proven knowledge of international human rights mechanisms and instruments, specifically CEDAW;
  • Excellent communication skills, ability to work in a team.
  • Experience with the organization of workshops and consultations, including with the members of Parliament, Government etc;
  • Previous professional experience with development agencies and the United Nations would be considered an asset

Languages and other skills: 

  • Fluent Ukrainian and Russian and at least basic knowledge of English;

Evaluation of Applicants:

Applications will be evaluated based on the cumulative analysis taking into consideration the combination of their qualifications and financial proposal. A two-stage procedure is utilised in evaluating the proposals, with evaluation of the technical proposal being completed prior to any price proposal being compared. The award of the contract should be made to the individuals whose offer has been evaluated and determined as:

  • Responsive/compliant/acceptable
  • Having received the highest score out of a pre-determined set of weighted technical and financial criteria specific to the solicitation.

Financial/Price Proposal evaluation:

  • Only the financial proposal of candidates who have attained a minimum of 49 points in the technical evaluation will be further considered and evaluated.
  • The total number of points allocated for the financial/price component is 30.
  • The maximum number of points will be allotted to the lowest price proposal that is opened/ evaluated and compared among those technical qualified candidates who have attained a minimum of 49 points in the technical evaluation. All other price proposals will receive points in inverse proportion to the lowest price.
