SCA Background

The Swedish Committee for Afghanistan (SCA) has been working in Afghanistan since 1982, presently managing development programmes concerning Health, Education, Rural Livelihoods and Community Governance, with a total annual budget of roughly USD 40 million. The total number of staff is around 5,500. During the last 10 years SCA has undertaken a change process moving from a primarily humanitarian service delivery approach towards more of a developmental role, putting increasing emphasis on capacity development, rights-based programming and outcome orientation. The mission of SCA is to empower individuals, communities and local organizations, primarily in rural areas and with particular focus on women, girls, boys and vulnerable groups such as people with disabilities, so that they may participate fully in society and influence their own development. Scope of work:

The Legal Advisor is to provide advanced legal expertise for the Country Director and ensure his/her involvement in all relevant legal aspects for SCA in Afghanistan, including but not limited to operational issues, contracts for goods/service, contracts of employment, and other personnel management related or  administrative legal issues;

Coordinate and liaise with other components of KMO and other international and Afghan stakeholders on issues where legal expertise is required;

Draft legal guidelines, assessments and recommendations for the CD and/or duly authorised delegates in terms of internal disciplinary and administrative proceedings;

Provide induction and other training with regard to general legal issues related to SCA operations.

To conduct any other tasks and assignments at the request of the CD.

Qualifications & Requirements:

  • Advanced University degree on Law (Master of Laws or equivalent);
  • A minimum of 10 years of relevant experience;
  • Practical experience as a Legal Adviser in the private sector or governmental office;
  • Proven knowledge of and experience in criminal law, labour law, contract law, international law, procedural law and administrative law;
  • Proven skills and experience in drafting laws, instructions, other regulations and assessments;
  • Knowledge of and experience in International missions related personnel and administrative procedures;
  • Prior mission experience in the field of Human Resources, Procurement/Contracting, Rule of Law or Justice is highly desirable.
  • 5-7 years relevant work experience within international development, with NGOs, UN agencies or similar organisation.

Main Responsibilities:

  • Provide Advice to the Country Director on all related legal issues applicable to employees of SCA, contractual issues to counter parts.
  • Advice on issues related to Memorandum of Understanding to other organizations
  • Advice the Country Director on internal rules and regulations that is not in coherence with applicable Afghan Laws.
  • Act as adviser regarding Disciplinary matters against SCA staff.
  • Draft correspondence related to issues of Legal nature to different offices and counterparts.
