1.         Organizational context

 

The position is located in the Procurement and Travel Division (PTD) of the Administration and Management Sector.

 

The Division is responsible for the procurement of general supplies, equipment, furniture, consumables and professional services provided by private commercial entities, for carrying out tendering processes and the establishment and administration of contractual agreements as well as for the purchase of goods and/or services to support WIPO's various programs in Geneva and in WIPO Member States. The Division also handles all travel administration for WIPO staff members and third party travelers, as well as contracts with individuals.

 

The incumbent advises work units on all legal aspects pertaining to the procurement of goods and services in accordance with the applicable rules and regulations, and provides advice on contracts with individuals and travel and mission-related activities.

 

The incumbent reports to the Director of the Division and to the High Level Officer for Procurement (HLOP) for specific assignments.

 

 

2.         Duties and responsibilities

 

The incumbent performs the following tasks\:

(a)      Review and provide legal advice on tendering processes, contract negotiation and any matters related to the implementation, amendment or termination of contracts. Participate in meetings with suppliers and WIPO Program Managers to negotiate terms and conditions or settlements.

(b)          Provide legal advice and support to the HLOP with regards to the interpretation or the periodic update of procurement rules and regulations, manuals, Office Instructions and other administrative issuances from the Division.

(c)          Conduct research related to procurement and contracting policy, and keep abreast of developments in particular in the IT domain and its latest technologies or services; make recommendations for the improvement of processes and procedures based on best practice; coordinate related work within the Sector and with Senior Management, as directed by and under the general guidance of the HLOP or the Director of the Division.

(d)          Formulate and draft complex legal agreements, contracts, contract amendments, memoranda of understanding, Office instructions, procedures, special legal provisions, formal letters and other legal documents.

(e)          Coordinate the Division’s legal activities and participate in meetings on complex legal issues in collaboration with the Office of the Legal Counsel, represent the Organization before any arbitral or administrative hearings resulting from a procurement action.

(f)           Serve in a senior secretarial capacity on various boards, committees (such as the Contract Review Committee), ad hoc working groups and task forces to advance sound managerial and legal practices for WIPO.

(g)          Represent the Division and/or Sector at specialized meetings and on internal bodies, boards and committees; prepare documents and deliver presentations on related procedural and legal matters.

(h)          Act as the Division’s risk management focal point and advise the Director on the management of legal and business risks; review and report on the identified risks and associated mitigation plans.

(i)            Perform other duties as required.

 

3.         Requirements

 

Education

           Essential

Advanced university degree in law, preferably with an emphasis on commercial international law. A first-level university degree in law plus two years of relevant experience in addition to the experience requested below may be acceptable in lieu of an advanced university degree.

Experience

           Essential

           Nine years of professional legal experience in international law including in drafting complex contracts based on service level agreements or key performance indicators, obtained in an international environment.

 

           Experience in drafting contracts for IT services.

 

           Experience in drafting procedures and regulatory frameworks.

 

           Desirable

           Practical experience in public or private procurement.

           Experience in drafting commercial contracts in the latest IT technologies or services such as Cloud or managed services.

           Experience in Swiss commercial law (Code des obligations).

           Experience in building/construction contracts.

           Experience in risk management.

           Experience in service in the capacity of Secretary of key committees.

 

Languages

           Essential

           Excellent written and spoken knowledge of English or French and good knowledge of the other.

           Desirable

           Excellent knowledge of both English and French. Ability to work in other UN languages.

5.         Information

 

Mobility\:  WIPO staff members are international civil servants subject to the authority of the Director General and may be assigned to any activities, office or duty station of the Organization.  Accordingly, the selected candidate may be required to move from time to time to new functions and/or to another duty station.

 

Annual salary\:

Total annual salary consists of a net annual salary (net of taxes and before medical insurance and pension fund deductions) in US dollars and a post adjustment.  The post adjustment (cost of living allowance) is variable and subject to change without notice in accordance with the rates as set within the UN Common System for salaries and allowances.  The figures quoted below are based on the October 2017 rate of 76.6%

Salaries and allowances are paid in Swiss francs at the official rate of exchange of the United Nations.

Additional Information

 

Initial period of two years, renewable, subject to satisfactory performance.  No fixed-term appointment or any extension hereof shall carry with it any expectancy of, nor imply any right to, (further) extensions or conversion to a permanent appointment.
