Background

BACKGROUND INFORMATION ON THE PROJECT:

UNDP’s “Rule of Law and Community Justice for Conflict-Affected Areas in Ukraine” Project started in January 2016 as part of a “Rule of Law for Stabilization in Ukraine” Programme and is an integral part of the Recovery and Peacebuilding Programme (RPP) in Ukraine Component 3: Community Security and Social Cohesion. The project is designed to address both the causes and consequences of the conflict, support stabilization efforts, and promote constructive and systemic change.

The Project has two key outputs:

Output 1: Strengthened personal and community security in conflict-affected areas;

Output 2: Increased community justice through capable institutions for rights-based service delivery and effective access to justice.

Output 2.1: Institutionalized primary and secondary legal aid system providing quality legal aid service to the vulnerable and conflict-affected population, including victims of SGBV.

Output 2.2: Justice Sector personnel are more responsive to community security needs especially conflict-related crime and SGBV

For promoting access to justice, there is a need to expand and strengthen knowledge of IDPs who may interact with numerous state agencies or would like to realize their rights by performing a smart-phone application in the form of the logical chain (step 1 leads to step 2 or step 3, step 2 leads to step 4 or step 5 etc.). The development of this application includes the identification of the most relevant IDPs’ legal issues, identifying legislation regulation of the issue, preparation of the answer on the issue.

The final result on this stage is to produce the Roadmap in the form of the logical chain on the most relevant legal issues regarding human rights realization in terms of the IDPs’ legal rights. The Roadmap will contain links on the current legislation and governmental hotlines (if relevant). The text must be prepared in the non-legal language (to be understandable for the non-lawyers). The document will be prepared in Ukrainian.

UNDP invites applications from highly-qualified and experienced Ukrainian professionals for the post of Consultant for development of roadmap (logical chain) for legal application on IDPs' Rights to prepare the Roadmap regarding Internally Displaced Persons’ rights realization.

Main objectives of the assignment 

The Roadmap (in the form of logical chain) will contain the following topics:

  • restoration of lost / damaged identification documents,
  • obtaining the pass through the Line of Contact,
  • obtaining of the IDP certificate,
  • restoration / obtaining of the social assistance,
  • restoration / obtaining of the pension
  • referral system to different I / NGOs

Duties and Responsibilities

The Consultant for development of roadmap (logical chain) for legal application on IDPs' Rights, under the supervision of the Community Security and Social Cohesion Specialist will be responsible for: 

  • Preparation of the Roadmap, using MS Office Word application, in the form of the logical chain on the most relevant legal issues regarding Internally Displaced Persons’ rights realization. The Roadmap will contain links on the current legislation and governmental hotlines (if relevant). The text must be prepared in the non-legal language (to be understandable for the non-lawyers). The document will be prepared in Ukrainian. Final electronic document should be sent via email.

Roadmap on IDPs’ legal rights in the form of the logical chain completed, reviewed and accepted by UNDP.

Up to 1 month after the starting date of the assignment.

Proposed payment schedule

UNDP will pay the negotiated amount in one tranche (100%) upon completion of Deliverable 1.

The payment will be done upon the full completion by Consultant and acceptance of contractual obligations by Community Security and Social Cohesion Specialist.

Monitoring/Reporting requirements

The Contractor will work under the overall guidance and report directly to the RPP Community Security and Social Cohesion Specialist. The contractor will report on work progress on a weekly basis through Skype/e-mails. The consultant will duly inform UNDP of any problems, issues or delays arising in the course of the implementation of the assignment, and take the necessary steps to address them.

  • Excellent team and networking skills.

  • Master’s degree or equivalent in law; completed Bachelor’s degree in combination with 2 additional years of relevant working experience may be accepted in lieu of Master’s degree;
  • Minimum 3 years of relevant work experience, including 1 year of practical experience in the field of IDPs’ legal rights and legal referral mechanism using;
  • Previous experience of work in the social security state authorities would be a strong asset;
  • Prior experience with civil society organizations would be a strong asset;
  • Professional fluency in written Ukrainian is essential, English and Russian are desirable.

Financial Proposal

 Lump sum contract

The financial proposal shall specify a total lump sum amount, and payment terms around specific and measurable (qualitative and quantitative) deliverables (i.e. whether payments fall in installments or upon completion of the entire contract). Payments are based upon output, i.e. upon delivery of the services specified in the TOR.  In order to assist the requesting unit in the comparison of financial proposals, the financial proposal will include a breakdown of this lump sum amount (including travel, per diems, and number of anticipated working days).  

The Consultant will be responsible for all personal administrative expenses associated with undertaking this assignment including office accommodation, printing, stationary, telephone and electronic communications, and report copies incurred in this assignment.

Travel costs

This assignment does not require any travel.

In the case of unforeseeable travel, payment of travel costs including tickets, lodging and terminal expenses should be agreed upon, between the respective business unit and the Consultant prior to travel and will be reimbursed.
