Background

Yemen is facing an unprecedented political, humanitarian, and development crisis. Yemen’s post-Arab Spring transition did not conclude peacefully and spiralled into a full-blown war in March 2015 which still continues. Yemen is the worst humanitarian crisis in the world with 7 million people on the brink of famine, over three million internally. Since March 2015, health facilities reported 8,757 conflict related deaths and over 50,610 injuries. The humanitarian crisis remains extremely widespread: an estimated 22.2 million people in Yemen need some kind of humanitarian or protection assistance, including 11.3 million who are in acute nee.  An estimated 17.8 million are food insecure, 16 million lack access to safe water and sanitation, and 16.4 million lack access to adequate healthcare.

A range of human rights violations have been documented – affecting women and children in particular. The conflict has destroyed infrastructure, eroded social cohesion and community stability, and damaged livelihoods and employment opportunities.  In the absence of meaningful employment and means of self-reliance, there has been an increase in negative coping strategies with reported increases in begging, child labour and child marriage, whilst in 2016, the UN documented 517 cases of child recruitment and 10 cases of arbitrary detention.

Despite inadequate state services for institutionalised protection even prior to the war, the armed conflict has further worsened the social balance in Yemen, and has weakened protection mechanisms that were safeguarded by a social balance that preserved peaceful co-existence amongst families and communities.

A full-fledged law-enforcement and justice system aligned with international standards remains a long-term objective. However, in the current conflict context, early interventions in the justice and rule of law sector can mitigate the impact of the current conflict and create the foundations for deeper UN engagement on rule of law and justice issues in the future.
Against this backdrop, UNDP Yemen developed two main programming pillars: 1) enhancing livelihoods and restoring of essential basic social services complementing the ongoing humanitarian effort 2) supporting (local) governance and peacebuilding to lay the foundations for eventual peace agreement in close partnership with the Office of Special Envoy of the Secretary-General for Yemen (OSEGY).

UNDP Yemen worked with the OSESGY to develop a Rule of Law Programme in response to the current challenges as set out above.

The Rule of Law programme portfolio currently consists of:
  • A joint UNDP UNICEF/UN Women project to improve living conditions for women and children in detention in Yemen, including improving physical conditions (such as water and sanitation repairs), support the rehabilitation of detainees with psychosocial support, education and vocational training, reintegration support and build knowledge of corrections staff on treatment of prisoners in accordance with human rights principles. The project is titled ‘Responding to protection needs and supporting resilience in places of detention’.
  • Anticipated funding for a community based access to security and justice project in four governorates of Yemen, with potential for further expansion to other areas. The project uses a bottom-up approach that relies on targeted assessments with local communities as well as police, justice personnel to identify the most pressing safety, security, protection and justice needs, in selected communities.
