Background

Promoting the rule of law is at the heart of the UNDP’s mission. Establishing respect for the rule of law is fundamental to achieving a durable peace in the aftermath of conflict, effective protection of human rights, and sustained economic progress and development. UNDP promotes effective, responsive, accessible and fair justice systems as a pillar of democratic governance. Democratic governance is undermined where access to justice for all citizens (irrespective of gender, race, religion, age, class or creed) is absent and rule of law is not guaranteed to all.
 
Kyrgyzstan’s transition to the Parliamentary form of governance with the adoption of a new Constitution in 2010, its plan for judicial reform and efforts to deliver security and services to its citizens continue to face political and economic challenges. Corruption is endemic within state administration. Reports of torture and extortion at the hands of the police continue to surface—despite the fact the Kyrgyzstan has become a party to many international human rights treaties. Meanwhile, many citizens—especially most vulnerable groups—lack any meaningful access to justice or livelihoods. April and June 2010 events and their consequences showed that there is strong need for strengthening the rule of law and creating an environment where all people regardless of their ethnic origin, gender or association to any particular social group have equal access to justice.
 
Accordingly, the focus of the “Enhancing the Democratic Rule of Law to promote peace and stability in the Kyrgyz Republic” Programme is upon building the capacity of justice and security actors to better implement laws, conduct oversight of government and security services, combat corruption, provide service delivery and security and afford citizens and most vulnerable groups access to justice, community security and empowerment.
 

Duties and Responsibilities

The CTA Rule of Law and Justice will work on the general supervision of the UNDP Deputy Resident Representative. In close collaboration with UNDP Senior Management and programme analysts the CTA shall provide high-level policy advice to the relevant national counterparts, provide programmatic oversight, lead policy advocacy, and liaise with UN Agencies, Government officials, technical advisors and experts, multi-lateral and bi-lateral donors and civil society in the areas pertaining to the Accountable Institutions, Rule of Law and Justice portfolio.  The CTA will also assure coordination and close collaboration with UNDP’s HQ and IRH units in the respective areas.
 
The CTA will also assume responsibilities for the overall management of the Accountable Institutions, Rule of Law and Justice portfolio, provide strategic planning and technical oversight to the joint strategy/programme/projects and ensure coherence and coordination with other UNDPs portfolio. S/he will create and maintain strategic partnerships with the Government, judiciary, civil society organizations, and key bilateral and multilateral actors.  S/he will provide in-depth analysis of the governance, legal and judicial systems and advise on strategies to enhance access to justice, in particular for vulnerable groups. S/he will perform the quality assurance functions for the joint projects in the area of responsibility.
 
Summary of Key Functions:
  1. Promote UNDP’s mandate and corporate policy and provide senior high level policy advice to government and other partners;
  2. Strategic guidance and advice to UNDP Senior Management for the implementation of projets portfolio in the area of Accountable Institutions, Rule of Law and Justice, including joint projects focusing on a fully coordinated approach to rule of law, access to justice, and justice reform and capacity development of justice sector institutions and actors;
  3. Strategic Planning, Quality Assurance of the Strategic and Results framework of the Accountable Institutions, Rule of Law and Justice projects portfolio, including joint projects, and coordinate the day to day management;
  4. Ensure resource mobilization and partnerships across the Accountable Institutions, Rule of Law and Justice sector;
  5. Ensure Knowledge management within the unit and other counterparts.
1. The Rule of Law Advisor shall promote UNDP’s mandate and corporate policy and provide senior high-level policy advice to government and other partners by undertaking the following:
  • Promote accountable institutions, rule of law and justice results, ensuring appropriate levels of visibility and public awareness on results and ongoing activities;
  • Provide policy advice to UNDP Senior Management, government counterparts, donors and other partners on issues related to Accountable Institutions, Rule of Law and Justice;
  • Develop a close partnership with the Ministry of Justice and other key national partners; and
  • Represent UNDP, as requested by the Resident Representative or Deputy Resident Representative, in meetings related to Accountable Institutions, Rule of Law and Justice issues.
2. Strategic guidance and advice for the implementation of the Accountable Institutions, Rule of Law and Justice Projects Portfolio focusing on a fully coordinated approach to rule of law, access to justice, and justice reform and capacity development of justice sector institutions and actors focusing on achievement of the following results:
  • Advise UNDP country programme on strategies and responses to changes in the rule of law and governance context, oversee rule of law programming, and develop and implement a rule of law programming approach with increased coordination of various rule of law projects;
  • Manage, supervise and provide strong leadership for UNDP Country Office staff working in the area of rule of law, and an overall strategic vision for all rule of law-related work with a view to building national capacities and strengthening the rule of law to support the overarching peace-building objective of the UN;
  • Ensure the integration of cross-cutting issues, such as gender and SGBV, peace building, PVE and human rights into programme/projects design, monitoring and evaluation;
  • Ensure regular monitoring and evaluation, including but not limited to, regular field visits and participation in Project Board and/or Steering Committee meetings;
  • Provide strategic guidance and advice to national institutions and actors on policy issues; strategic planning, research and monitoring and evaluation, including key performance indicators, strategic plans for various organizations and research into various issues which impact on institutional performance, especially for rule of law and access to justice; 
  • Advice on identifying entry points to achieve a mixture of short-term and medium term results which produce tangible improvements to improve access to justice at local level;
  • Ensure the technical work undertaken across the joint programme is in line with international good practice and adapted to the local context;
  • Contribute to building a strong understanding of the political dimension of the justice sector to identify the drivers and blockers of change and then develop strategies to ensure that project implementation is achieving impact;
  • Ensure technical soundness of project activities and achievement of project outputs and outcomes.
3. Strategic Planning, Quality Assurance of the Strategic and Results framework of the Accountable Institutions, Rule of Law and Justice projects portfolio, including joint projects, and coordinate the day to day management:
  • Provide advice and guidance for the strategic planning and the implementation of the programmes/projects portfolio, including joint projects and work plans, ensuring appropriate coordination and integration with the country programme components;
  • Ensure the results specified in the annual work-plan of the Programme/Projects meet the required standard of quality, in a coordinated way and within the specified constraints of time and cost;
  • Liaison between UNDP and other UN Agencies on issues pertaining to Accountable Institutions, Rule of Law and Justice area;
  • Coordinate day to day management and guidance of the unit work;
  • Supervise and support the work of the UNDP Project Managers and their teams in the area of responsibility;
  • Formulate an effective monitoring and evaluation system of the programme/projects in the area of responsibility and report on progress, including reporting to UNDP, development partners and national stakeholders on progress;
  • Facilitate and ensure quality assurance of reports including Progress Reports, Financial Reports, Annual Progress Reports, etc. and ensure timely completion of technical reports for the Programme/Projects portfolio in the area of responsibility;
  • Support the DRR in leading the UNDAF  Result Group on Governance, Rule of Law, Human Rights and Gender Equality.
4. Resource mobilization and partnerships across the Accountable Institutions, Rule of Law and Justice sector focusing on achievement of the following results:
  • Engage in a dialogue with development partners and onors, identify funding opportunities and endeavour to ensure sufficient resource mobilization for the programme in close consultation with Senior Management and be responsible for reaching the annual resource mobilization targets;
  • Support UNDP efforts for resource mobilisation for the Accountable Institutions, Rule of Law and Justice projects portfolio;
  • Coordinate programme activities with other UNDP initiatives as well as other United Nations agencies, donors, and other international partners, to develop inter-agency synergies and build complementarities with other programs;
  • Advocate for UNDP work in the area of responsibility and represent UNDP Accountable Institutions, Rule of Law and Justice projects portfolio with national authorities, UN agencies, the donor community, and international financial institutions;
  • Raise visibility of the programme/projects through knowledge sharing and well developed communication materials;
  • Develop pilot initiatives for functional partnerships between justice sector stakeholders and non-governmental organisations, local media and the public;
  • Support joint communication efforts;
  • Liaise regularly and forge close linkages with other UN programmes, agencies and entities, as well as other international and national stakeholders concerned with or providing assistance on justice/rule of law issues;
  • Ensure high-quality and timely reporting to donors and other partners involved in the programme;
  • Contribute to the harnessing of effective partnerships and competitive selection of partners for implementation of UNDP projects; and promote joint programming, and collaborate effectively in established frameworks for UN and other international coordination.
5. The Rule of Law Advisor shall ensure knowledge management focusing on achieving the following results:
  • Identification and synthesis of best practices and lessons learned from the project area for organizational sharing and learning as well as external information;
  • Active participation in UNDP knowledge networks and taking advantage of best practices and lessons learned that are available in the region and globally, and encouraging project staff to do so by creating a culture of knowledge sharing and learning;
  • Promoting the participation of UNDP Kyrgyzstan in regional programmes and regional activities related to the project area as appropriate; and
  • Supporting capacity and knowledge building of national counterparts.
 
Impact of results:
 
The Accountable Institutions, Rule of Law and Justice will enable UNDP, in partnership with the parliament, the Government, human rights institutions, civil society organizations, communities, and the main target groups – women, youth and vulnerable populations – to contribute to sustainable development goals 5 and 16, with indirect impact on goals 3 and 10 and enhance accountability, transparency, the effectiveness and efficiency of institutions to respond to citizens’ expectations for rule of law and justice, more effective services, and economic development.

Required Skills and Experience

Education:
  • Master’s degree in the areas of Law, Political Science or related discipline.
Experience:
  • At least 7 years of progressively responsible experience in rule of law, access to justice and democratic development related fields; 
  • Previous experience in post-conflict areas is an asset;
  • Experience in managing and supervising programmes and projects aimed at enhancing rule of law, developing the capacities of the justice sector;
  • Experience working with all of the major actors of the justice sector is required;
  • Experience of working in a technical advisory, policy development and capacity building;
  • Demonstrated programme management skills including: results-based orientation, preparation of work plans, monitoring and evaluation; 
  • Strong knowledge/ experience in results based management and results oriented approach to project implementation;
  • Excellent analytical and interpersonal skills including oral and written communication;
  • Excellent team player with an ability to work in a multi-cultural team split across multiple locations;
  • Experience with UN/UNDP programmes in the area of rule of law, access to justice and democratic development is an asset;
Language Requirements:
  • Fluency in English and ability to draft and edit project documents, proposals, correspondence, briefings and presentations in English;
  • Knowledge of Russian language is an asset.
