TERMS OF REFERENCE – CONSULTANT

NAME:  Consultant- Assessment of barriers for undocumented children born to IS members, and in IS controlled territory, and female survivors of IS sexual violence or alleged IS affiliates

TITLE:  An Undocumented Generation - The impact on children of being born under Islamic State

DUTY STATION: Kirkuk (with travel to Mosul, West Anbar and Hawiga)              

REPORTING TO:  ICLA PM- Kirkuk                  

 

1.         BACKGROUND

 

NRC’s Information, Counselling and Legal Assistance (ICLA) and Gender-Based Violence Programmes are seeking a consultant to conduct an assessment report of the legal, procedural and social challenges faced by undocumented children born to IS members, and in IS controlled territory, and female survivors of IS sexual violence or alleged IS affiliates; the scale of the problem; recommended programming; and advocacy strategies to address the challenges. The focus of the research will be on areas formerly controlled by IS, including Hawiga, Mosul and West Anbar.

The consultant’s research will, at a minimum:

 

  • Map the legal and procedural framework in Iraq governing nationality and the issuance of birth certificates.
  • Provide an in-depth analysis of the legal and procedural barriers which prevent children from obtaining birth certificates and nationality certificates.
  • Examine the violence and stigma faced by women who have survived rape or are alleged to be the wives or family members of IS members, and the impact this has on the legal status of their children.
  • Examine the legal, procedural customary framework in Iraq governing treatment of survivors of GBV perpetrated by IS and women alleged to be the family members of IS members, focusing on the impact of this framework on accessing civil documentation for themselves and their children.

The consultant will conduct a thorough review of the legislation and literature followed by field visits to Hawiga, Mosul and West Anbar. This field research should include interviews and focus group discussions with women with undocumented children born to IS members or in IS controlled areas, and with women who have alleged IS affiliations or are survivors of IS sexual violence. She/he should triangulate the data gathered by interviewing government and court officials and humanitarian actors (Child Protection and GBV), and interviewing and conducting focus group discussions with NRC ICLA. The consultant will be conscious that the findings may differ between areas in Iraq and clearly differentiate between the research locations in the report.

 

The research report should include clear recommendations for programming and advocacy, and differentiate between the audiences for each recommendation in the report.

 

NRC will publish the consultant’s report on the findings of the research, which will influence the future programming of NRC and humanitarian actors to better respond to the needs of the research target group, and to advocate for the removal of legal, procedural and cultural barriers for the target group.

 

2.         OBJECTIVES

The consultant is required to:

  1. conduct research; and
  2. draft a report

on the legal, procedural and social challenges faced by undocumented children born to IS members, and in IS controlled territory, and female survivors or alleged IS affiliates; the scale of the problem; recommended programming; and advocacy strategies to address the challenges focusing on areas formerly controlled by IS, including Hawiga, Mosul and West Anbar.

4. ADDITIONAL COMMENTS

 

  • The research team will consist of one consultant with experience in law and women’s rights and GBV. 
  • Applicants must submit a detailed description of the proposed work, research methodology (including how they will research the sexual violence of women ethically), and budget to achieve the milestones listed above.
  • Applications must include references and examples of previous reports, academic writings and consultancies. Examples of writing completed for NRC is preferred.
  • This contract includes delivery of project activities outlined above, as well as the consultant’s availability to provide any additional support, advice or representation that is mutually agreed by both parties.
