THE ASSIGNMENT 

IDLO, Judiciary (Chief Registrar of the Judiciary, the Presiding Judge of the Commercial Division of the High Court and the Judiciary Commercial Training Committee, seek to recruit a technical expert to undertake a commercial justice training needs assessment and utilize it to inform the development of a curriculum and training manual.

Under the overall supervision and direction of the Chief Registrar of the Judiciary, the Presiding Judge of the Commercial Division of the High Court, and in consultation with the IDLO Kenya team, the Expert will

  •  Undertake and facilitate the validation of a commercial and tax law Training Needs Assessment through a process of role player consultation and research utilizing the draft 2012 curriculum as a baseline.

  •  Utilize the approved Training Needs Assessment, and additional role player engagements and research, to develop a draft curriculum on commercial law as well as a comprehensive training manual comprised of all the subjects  identified in the draft curriculum. 

 • Integrate the principles of equality and non-discrimination into the curriculum and training manual.

 • Support the processes of formalising the curriculum and training manual through the Judiciary’s processes and its High Court Advisory Committee.

 • Perform such other duty as may be assigned in line with the project via the Presiding Judge of the Commercial Division of the High Court and IDLO.

 

IDEAL CANDIDATE PROFILE

Education

 •  The candidate will be a holder of a law degree and a post graduate degree in law, economics, social sciences, development or related discipline to commercial justice sector.

Work experience

  • Have at least 10 years of professional experience regarding rule of law and commercial sector reforms, and experience in project implementation and management, legal research, analysis and writing, particularly in the field of   commercial law, Gender and justice sector reforms. Commercial alternative dispute resolution experience, and experience and administration in areas related to judicial reforms an added advantage.

Languages

  • Fluent oral and writing skills in English is required.

Technical competencies

  • Must possess strong understanding of alternative dispute resolution and have demonstrated experience in legislative drafting/research.

  • Experience developing gender responsive training needs assessments and curricula in similar fields.

  •  The candidate will possess strong understanding of investment climate topics such as commerce, bankruptcy, investment policy, investment generation and regulatory environment.

  •  Strong understanding of the rule of law, including general familiarity with constitutional and institutional reforms in Kenya and/or the region/similarly placed jurisdictions.

  •  Familiarity with the social, political and economic context in Kenya and/or the region/similar jurisdictions. Experience in more than one country context is a significant advantage.

  •  A good understanding of the nature and needs of the Commercial Division of the High Court of Kenya and/or other similarly placed judiciaries/divisions to assist and develop improved systems within such context.

  •  Possess strong work ethic characterized by desire to achieve results. Ability to multi-task in a high-pressure environment, respond rapidly to ad hoc requests, meet tight deadlines and ensure diplomacy and tact when engaging  with prominent public figures.

  •  Should possess excellent interpersonal, diplomacy skills and communication skills.

  •  Ability and willingness to travel in region, if necessary.
