Consultancy: Development of The Implementation Framework For The Policy And Legal Audit Report

BACKGROUND

The Council of Governors (CoG) and the Kenya Law Reform Commission (KLRC) undertook an audit of policy and law exercise in the following seven (7) thematic areas: Agriculture; Health; Natural Resource Management; Public Finance Management; Land and Physical Planning; Urban Development; Trade and Investment. Subsequently, a report on the aforementioned sectors was launched by the President during the 6th Annual Devolution Conference held in Kirinyaga County.

It is against this backdrop that IDLO, CoG and the KLRC seek to engage an individual consultant to develop an implementation framework for the audit report with a view to actualize the recommendations highlighted in the report.

 

THE CONSULTANCY ASSIGNMENT

IDLO will provide technical assistance to develop an implementation framework and recommendations report in the form of a contracted expert, to review the legal audit report and develop an implementation matrix. IDLO also anticipates that the COG and KLRC will complement the technical assistance including from actors in devolution team to ensure this will be a participatory process, thus ensuring buy in for the final product. 

It is in light of the foregoing context that the COG, seek to recruit a national consultant to carry out a review of the legal audit report and develop an implementation framework for the implementation of recommendations contained in the legal audit report.  

Duties and Responsibilities;

  • Development of a high quality report in line with the above stated objectives.
  • Carry out a desk review of all legislation and policies relevant to the mandate of devolution 
  • Review various thematic sector reports contained in the sector legal audit reports
  • Review the main legal audit report containing recommendations for reform 
  • Concisely bring out the priority areas for policy/legal reform based on findings from the legal audit
  • Prepare a detailed work plan and budget for each of the 7 sectors 
  • Facilitate a stakeholder engagement for review of the implementation framework and incorporate comments from stakeholders
  • Any other necessary task related to fulfilling the objective of the consultancy, in liaison with IDLO COG and KLRC

The consultant will, at all times:

  • Carry out the services and perform his/her tasks with care, skill and in an efficient and professional manner.
  • Observe strict confidentiality.
  • Ensure a high degree of quality in his/her output.
  • Be guided by these terms of reference.
  • Carry out his/her tasks on the field, presenting outputs to IDLO COG and KLRC on/or before agreed deadlines.

DELIVERABLES

A comprehensive framework for implementation of the reforms to the key functions outlined in the legal audit report.

SUPERVISION

The Assignment will be managed by the Technical Committee which comprises of representatives from the CoG and the KLRC.  The Consultant will be required to report to, and coordinate with this Committee throughout the Assignment.

ESTIMATED TIMELINES AND CONSULTANCY FEES

It is expected that the work will start shortly after the signing of the contract, payment will be spread across the delivery period for the services rendered in furtherance of these terms of reference. The fees shall be paid in three instalments as follows:

  • 20% on submission and approval of the inception report, including robust work plan;
  • 40% on submission and approval of the draft implementation framework; and 
  • 40% on the successful conclusion of the assignment, particularly the submission of a final report and the final version of the assignment report and all deliverables envisioned under the contract.
  • All fees are subject to a 5% KRA withholding tax.

DURATION 

The assignment will be carried out over a period of thirty five (35) days.

QUALIFICATIONS

  • Bachelors and Master’s degree in Economics, Law, Public Policy or any related field;
  • Have experience of similar tasks and at least ten (10) years professional experience;
  • Be familiar with the devolved system of government;
  • Demonstrate their understanding of the terms of reference;
  • Excellent command of written English and strong analytical and critical thinking skills
  • Submit a detailed CV with relevant certificates
