Background

High and sustainable growth of urban population of Turkmenistan leads to increasing challenges in regard to impact on environment. Sources of these effects are various – expansion of lightening of social area, increasing the consumption of energy in new residential and touristic zones which leads to the rise of greenhouse gas emissions and negatively contribute to the global climate change. Project objective is to promote and implement integrated low-carbon urban systems in Ashgabat and Avaza, thereby reducing GHG emissions and creating other environmental, social, and economic development benefits. 

In order to reach these aims it is necessary to develop regulatory legal acts and regulatory technical documentation. Current regulatory documents are fall somewhat short of requirements on energy efficiency in which criteria directed to reducing GHGs is not considered. Implementation of low-carbon GHG urban systems and creation of environmental, social, and economic development benefits are impossible without development of new regulatory legal acts and regulatory technical documents that correspond to requirements of green economy.

Development of renewable energies is one of the directions that ensures the reduction of GHG. It is necessary to create regulatory legal and regulatory technical base in order to comprehensive and systematic introduction of new technologies to national economy by using renewable energies (RE). Within the framework of UNDP/GEF “Sustainable Cities in Turkmenistan: Integrated Green Urban Development in Ashgabat and Avaza” project, specialists and international consultant of the project developed draft Law of Turkmenistan “On Renewable Energy” late in 2019 and during the first half of 2020. Draft of law was agreed by key Ministries of Turkmenistan and by the procedure conveyed to Mejlis (Parliament) of Turkmenistan for review. At present, special working group was created in the Mejlis of Turkmenistan for discussion and adoption of Law of Turkmenistan “On Renewable Energy”. Project specialists are actively taking part in the working group.

In order to improve RE in the country, it is also necessary to develop draft of National Strategy of Turkmenistan on Development the Renewable Energy. In addition, after adoption of the Law of Turkmenistan “On Renewable Energy” it is essential to develop number of regulatory legal acts in the field of renewable energy for achieving its goals and tasks. In accordance with the Decree of President of Turkmenistan dated on 26 June 2020, was created the Inter-ministerial Working Group for development of National Strategy of Turkmenistan on Development the Renewable Energy. First session of the Inter-ministerial Working Group was held on 9 July 2020 in which representatives of UNDP Sustainable Cities project took active participation. UNDP presented preliminary version of structure of National Strategy of Turkmenistan. During the session, there was a presentation of works undertaken in the field of renewable energy and energy efficiency realized by the UNDP project.

 As a result of the working group session, UNDP Sustainable Cities project was invited to continue its active participation in the development of draft National Strategy of Turkmenistan on Development the Renewable Energy. In this regard, the UNDP project plans to hire International Consultant on development the draft of National Strategy of Turkmenistan on Development the Renewable Energy and draft of four (4) regulatory legal acts related with the Law of Turkmenistan “On Renewable Energy” pursuant to requirements of green economy and based on international experience.    

As a result of the development and adoption of National Strategy, there will be plenty of possibilities for comprehensive development of renewable energy usage in Turkmenistan.  

Duties and Responsibilities

  1. TASKS AND ACTIVITIES

Main objective of the task is to develop the draft of National Strategy of Turkmenistan on Development the Renewable Energy and draft of four (4) regulatory legal acts related with the Law of Turkmenistan “On Renewable Energy”  in accordance with requirements of green economy and based on international experience. In this regard, International Consultant of UNDP/GEF “Sustainable Cities in Turkmenistan: Integrated Green Urban Development in Ashgabat and Avaza” project under the direct supervision of Project Specialist on energy efficiency and with the coordination of Project Manager will be responsible for implementation of following tasks:   

  1. Working in the working group, analysis of source information and development of the draft National Strategy of Turkmenistan on Development of the Renewable Energy in accordance with requirements of green economy and based on international experience;    
  2. Working in the working group, analysis of source information and development of draft of four (4) regulatory legal acts related to the Law of Turkmenistan “On Renewable Energy” in accordance with requirements of green economy and based on international experience;
  1. Rules for origin of energy produced by renewable energy including the issuance of certificate that confirms the origin of energy (“green” certificate);
  2. Regulation on maintaining the state cadaster of renewable energy and its data use, including the rules for identification and inventory of sites for the possible location of facilities on use of renewable energy, and rules that are added to the state cadaster of renewable energy sites for the possible location of facilities on use of renewable energy; 
  3. Section regarding the rules on use of electric and thermal energy titled as “Ensuring the guaranteed connection of the installations on use of renewable energy to the state energy networks”;
  4. Section regarding the rules on use of electric and thermal energy titled as “Guaranteed purchase of all proposed energy that are produced by renewable energies by the state power supply enterprises and its provision to the state energy networks by producers of energy that is produced by renewable energy, as well as its payment at established tariffs”.
  1. Delivery of final Report on implemented work.

Number of expert-days and delivery deadline: 40 expert days.

Deadline for delivery of the result – within 2 months from the contract start date.

Payment arrangements: 35% of the total contract budget

Deliverable 2

2-1) Developed draft “Rules for confirming the origin of energy produced by renewable energy, including the issuance of a certificate of confirmation of the origin of energy (“green” certificate).

Number of expert-days and delivery deadline: 20 expert days.

2-2) Developed draft “Regulation on order of maintaining state cadaster of renewable energy and use its data, including rules for the identification and inventory of sites for the possible location of facilities for the use of renewable energy sources and rules for inclusion to the state cadaster of renewable energy sites for the possible location of facilities for the use of renewable energy; 

Number of expert-days and delivery deadline: 20 expert days.

Deadline for delivery of the result – within 4 months from the contract start date.

Payment arrangements: 30% of the total contract budget

Deliverable 3

2-3) Developed draft section of the Rules for the use of electric and thermal energy “Ensuring guaranteed connection to the state energy networks of installations for the use of renewable energy sources”.

Number of expert-days and delivery deadline: 20 expert days.

2-4)  Developed draft section of the Rules for the use of electric and thermal energy “Guaranteed purchase by state power supply enterprises of all proposed energy produced by renewable energies and supplied by producers of energy produced by renewable energy sources to the state energy networks, as well as its payment at established tariffs”.

Number of expert-days and delivery deadline: 20 expert days.

3)    Delivery of final Report on implemented work.

Number of expert-days and delivery deadline: 10 expert days.

Deadline for delivery of the result – within 6 months from the contract start date.

Payment arrangements: 35% of the total contract budget

Remark: Present legal acts of Turkmenistan and other documents of Turkmenistan which are necessary to implement the work will be presented by the project to the International Consultant in Russian language.

 

Competencies

  • Ability to collect, analyze and summarize received data;  
  • Good organizational skills;

  • Ability to work effectively under time constraint for implementation of tasks;
  • Excellent ability and experience in writing and presentation of reports on high professional level (including using graphics, pictures, diagrams, and other graphic instruments that increases the quality of report).

Required Skills and Experience

Education:

  • Higher education in the field of energy, energy efficiency, industry, construction and related disciplines

Experience:

  • At least 15 years of working experience in energy power industry, energy efficiency and renewable energy related sectors.
  • Excellent knowledge of modern approaches and advanced international experience, business-practice, policy, and regulation in the field of renewable energy.
  • Experience in preparation of reports and reviews, strategies, sub-laws, regulatory legal documents, standards, technical regulatory legal acts in the field of energy, energy efficiency, renewable energy.
  • At least 10 years of experience on holding energy research of organizations of various sectors of the economy including international as well as regulation of consumption of fuel-energy resources.   
  • Good knowledge of policy and regulation in the field of renewable energy, energy-saving, and energy efficiency in Turkmenistan and abroad.
  • Professional use of information technology as a tool and resource base; computer skills, including working with Word, Excel files, etc.

Language requirements:

  • Excellent knowledge of Russian language
  • Knowledge of English language is an asset

Interested individual consultants must submit the following documents/information to demonstrate their qualifications:

All experts applying for this position are required to provide:

  • Brief (1-2 pages) description of the methodology for the assignment.
  • Cover Letter which contains a brief description of approach to work/technical proposal of why the individual considers him/herself as the most suitable for the assignment, and a proposed methodology on how they will approach and complete the assignment; (maximum 1 page);
  • A summary of experience in similar assignments;
  • Financial Proposal with the references to (1) the daily rate for the assignment and within the timing scale indicated in the present TOR, and (2) any other expenses (including transportation costs, accommodation costs, the possibility of vaccination and etc.). Template of the form can be found at   http://www.tm.undp.org/content/turkmenistan/en/home/procurement.html. The UNDP will enter into an Individual Contract based on a lump sum amount. The financial proposal shall represent a detailed, justified and “all inclusive” amount.  In order to assist UNDP in the comparison of financial proposals, the financial proposal shall include a breakdown of this lump sum amount, including: a daily fee for the tasks and an estimated duration as specified in this announcement, travel (to and from the missions), per diems, any other possible costs (including vaccinations, dwelling, communication etc.);
  • Personal CV form including past experience in similar projects and contact details of referees.

 

 Evaluation of proposals:

Individual Consultants will be evaluated based on the combined scoring methodology. When using this method, the award of the contract should be made to the individual consultant whose offer has been evaluated and determined as:

Responsive/compliant and having received the highest score – out of 100 points

Out of the maximum score, the score for technical criteria equals 70% - maximum 70 points, and for financial criteria 30%.

The technical evaluation will take into account the following as per the scoring provided:

  • Education in the area of Energy, Electric Engineering, Energy Efficiency, Energy Management, Renewable Energy and closely-related fields – 15 pts;
  • At least 15 years of working experience in energy power industry, energy efficiency and renewable energy related sectors – 25 pts;
  • More than 10 years’ experience in preparation of reports and reviews, strategies, regulatory legal documents, standards, technical regulatory legal acts in the field of energy, energy efficiency, renewable energy – 35 pts;
  • Experience in CIS countries – 10 pts; Experience/familiarity with Turkmenistan will be a great advantage;
  • Fluency in Russian – 10 pts;
  • Fluency in English – 5 pts.

Financial proposal – 30% of total evaluation.

Additional requirements for recommended contractor:

Recommended contractors aged 65 and older, and if the travel is required, shall undergo a full medical examination including x-ray, and obtain medical clearance from the UN-approved doctor prior to taking up their assignment. The medical examination is to be cleared by the UN physicians, and shall be paid by the consultant.
