Background

a. Purpose

 

Analyze the needs of judicial institutions in Serbia and in the Western Balkans in terms enhancing their technical capacities for data management, exchange and publication and advise the team of the Regional War Crimes (RWC) project – Western Balkans on project activities to address these needs. 

 

b. Objective

 

To establish the needs of the judicial institutions in Serbia and in the region (Bosnia and Herzegovina, Montenegro, Croatia) with a view of enhancement and modernization of their capacities to digitize, process, share and publicize, in line with data protection legislation, their data, including, but not limited to, provision of data analysis software and hardware, creation of a regional data base of jurisprudence, improvement of the institutions’ websites, and advise, accordingly, the RWC project team in development of concrete project activities. 

 

c. Background Information

 

War crimes and other atrocities committed during the period of armed conflict that accompanied the break-up of the former Yugoslavia continue to affect relations among different ethnic groups in the region. The legacy of war crimes and the persistent impunity gap together with some other consequences of the conflict such as unresolved fate of the missing persons, still significantly contribute to frustrations, grievances, lack of trust and ethnic polarization at an inter-personal level. This current situation also creates tensions and undermines reconciliation efforts at local community, national and state levels, and is especially detrimental to the region’s multi-ethnic society. The failure to resolve these issues furthermore fuels radicalization among ethnic and political groups, especially among younger generations. 

To address the legacy of the armed conflicts, a boost to technological capacities of the institutions in charge of war crimes case processing, as well as to those dealing with the search for the  missing persons, is necessary, for which UNDP will need support of a consultant.

Duties and Responsibilities

The consultant will work under supervision of the RWC project’s Chief Technical Advisor. The consultant will gather necessary information from the RWC project’s national counterparts in Serbia, BiH, Croatia and Montenegro and other sources, prepare an analysis of their needs and current technical capabilities as well as feasibility of certain technical and capacity building solutions, and advise the RWC project team on a most appropriate and most cost-efficient course of action and project activities. The services will be as follows:

 

The consultant will deliver its services through up to 18 working days from 28 September 2020 to 28 February 2021.

Gathering information on the technological needs and gaps in the courts and prosecution offices (dealing with war crimes) as well as institutions for search of missing persons and law enforcement in Serbia, BiH, Croatia and Montenegro

  • Strong knowledge of judicial organisation, judicial reform, criminal law and procedure, human rights law; 
  • Strong expertise in IT sector, especially in data processing and data analysis, or in provision of support to the national judicial institutions.

Required Skills and Experience

Requirements for experience and qualifications

Education:

 

  • Advanced University degree in Law, or IT, or other technical sciences.

 

Work experience:

 

  • Minimum ten years of experience in working on application of IT and other technological solutions in the justice sector.
  • Strong experience in capacity development of judicial institutions in Serbia or in the region of the Western Balkans. Working for international organisations’ projects on justice system reforms, including provision of IT and other technological support, would be a strong asset. 
  • Experience in working with courts, prosecution offices, ministries of justice or ministries of public administration.

 

 

1. Cumulative analysis

When using this weighted scoring method, the award of the contract should be made to the individual consultant whose offer has been evaluated and determined as:

a) responsive/compliant/acceptable, and                                                                                 

b) Having received the highest score out of a pre-determined set of weighted technical and financial criteria specific to the solicitation.

Additional Information:

 

  • Individual Contract (IC) will be applicable for individual consultants applying in their own capacity.  If the applicant is employed by any legal entity, IC would be issued upon submission of Consent letter from the employer acknowledging the engagement with UNDP.   • Reimbursable Loan Agreement (RLA) will be applicable for applicants employed by any legal entity. Template of RLA with General Terms and Conditions could be found on: http://www.undp.org.rs/download/RLA%20with%20General%20Terms%20and%20Conditions.doc. In the case of engagement of Civil servants under IC contract modality a no-objection letter should be provided by the Government entity. The ‘no-objection’ letter must also state that the employer formally certifies that their employees are allowed to receive short-term consultancy assignment from another entity without being on “leave-without-pay” status (if applicable), and include any conditions and restrictions on granting such permission, if any. If the previous is not applicable ‘leave-without-pay’ confirmation should be submitted.

 

Engagement of Government Officials and Employees

 

  • Government Officials or Employees are civil servants of UN Member States.  As such, if they will be engaged by UNDP under an IC which they will be signing in their individual capacity (i.e., engagement is not done through RLA signed by their Government employer), the following conditions must be met prior to the award of contract: 

(i)       A “No-objection” letter in respect of the individual is received from the Government employing him/her, and; 

(ii)     The individual must provide an official documentation from his/her employer formally certifying his or her status as being on “official leave without pay” for the duration of the IC. 

 

  • The above requirements are also applicable to Government-owned and controlled enterprises and well as other semi/partially or fully owned Government entities, whether or not the Government ownership is of majority or minority status.   

 

  • UNDP recognizes the possibility that there are situations when the Government entity employing the individual that UNDP wishes to engage is one that allows its employees to receive external short-term consultancy assignments (including but not limited to research institutions, state-owned colleges/universities, etc.), whereby a status of “on-leave-without-pay” is not required.  Under such circumstance, the individual entering into an IC with UNDP must still provide a “No-objection” letter from the Government employing him/her.  The “no objection” letter required under (i) above must also state that the employer formally certifies that their employees are allowed to receive short-term consultancy assignment from another entity without being on “leave-without-pay” status, and include any conditions and restrictions on granting such permission, if any.  The said document may be obtained by, and put on record of, UNDP, in lieu of the document (ii) listed above.
