Organisational Context

The Victims and Witnesses Section (VWS) organisationally belongs to the Division of External Affairs and Field Operations in the Registry. It provides protective measures, security arrangements, counselling and other appropriate assistance to witnesses and victims who appear before the Court and to others who are also at risk on account of testimony given by such witnesses. The Section may advise the Prosecutor and the Court on appropriate protective measures, security arrangements, counselling and assistance.

The Section is responsible for ensuring that the witnesses appear in the Court appropriately protected, supported and as scheduled by the Chambers. Furthermore, it is responsible for the management of the ICC Protection Programme (ICCPP) and may cooperate with States, intergovernmental and non-governmental organisations in providing any of the protection and support measures stipulated by the Statute.

 

Duties and Responsibilities

Within this framework, and under the direct supervision of the Senior Manager, the incumbent performs the following duties:

  • Manages and supervises a multicultural team in the field and Headquarters in the provision of adequate support, protection and other assistance required for witnesses and victims appearing before the Court, and other persons as appropriate;
  • Enhances the capacity of the team to provide mandated services through training, capacity building and addressing staff welfare issues;
  • Provides guidance for and supervises the development of local protection measures, including response systems, for victims and witnesses in the relevant situation areas;
  • Is responsible for the assigned day-to-day operations of the ICCPP, receives referrals, conducts initial consultations and assessments, assigns subsequent threat/risk assessments, psychosocial assessments;
  • Recommends approval to ICCPP and develops a management plan reflective of the threat and psycho-social assessments that correspond to the statutory obligations of the VWS, other relevant regulatory frameworks and international good practices for each assigned person accepted to the ICCPP in the situations;
  • Coordinates and supervises the implementation of the management plans for each protection programme participant, ensuring that the execution of the plans takes into account the individual circumstances of the participants with the aim of achieving the self-sustainability of the participants as soon as practicable;
  • Coordinates logistics, support and protection workflows within his/her team and cooperates with other entities of the VWS to guarantee that witnesses and where relevant, victims appear in the Court appropriately and adequately assisted, supported and protected;
  • Provides input to the drafting of VWS submissions to the Court, represents the Section in the Court proceedings and makes oral submissions during the proceedings on behalf of the unit;
  • Acts as focal point and establishes impartial, effective relationships with the relevant parties, participants, Chambers and other relevant entities participating in the Court proceedings and responds to service requests;
  • Coordinates the establishment and maintenance of an effective network with authorities and entities in the situation, or other relevant countries, necessary for the work of the VWS in the two situations and ensures the operational implementation of cooperation agreements with host governments, embassies, international and non-governmental organisations, military contingents and other relevant entities;
  • Develops situation and case-specific risk and threat assessments and keeps regularly up-to-date on the political, socioeconomic and security situation in respect of the situations assigned, in close coordination with the Analysis Team of the VWS and other relevant entities of the Court;
  • Maintains appropriate and, where necessary, intrusive oversight and control mechanisms of all VWS operations and activities within the situations assigned, especially in relation to the case management within the ICCPP;
  • Protects the safety, physical and psychological wellbeing, dignity and privacy of all victims and witnesses with regard to all relevant factors including age, health and nature of the crime, in particular, but not limited to, where the crime involves sexual or gender violence or violence against children;
  • Maintains confidentiality at all times, respects the interests of the witness and acts impartially when cooperating with all parties.

 

The incumbent, prior to commencing his/her duties, is required to sign a confidentiality agreement with the VWS.

 

The Chief VWS may redeploy the incumbent and/or the post either temporarily or permanently to another duty station pending the operational requirements of the VWS.

 

Essential Qualifications

Education:

Advanced university degree in law, political sciences, international relations, risk management or other related area. A first-level university degree in combination with two additional years of qualifying experience is accepted in lieu of an advanced university degree.

Or police, military or comparable law enforcement training and/or equivalent qualifications combined with 11 years of relevant experience may be considered in lieu of a university degree.

 

Experience:

  • A minimum of five years of progressively responsible professional experience (seven years with a first-level university degree) in witness-related activities within court or law enforcement structures;
  • A minimum of five years of supervisory full-time work experience in a national or international witness protection programme is required;
  • Demonstrated supervisory and operational experience, understanding of witness protection and support operations, and the ability to manage risk in a highly dynamic environment is required;
  • Experience in taking management decisions in relation to protected persons in a witness protection programme is required;
  • Experience in planning protection operations and managing risks in demanding circumstances is required;
  • Experience in conducting threat and risk assessments is required;
  • Experience in planning operations and managing risks in demanding circumstance is required;
  • Experience in rapidly assimilating conflicting information, making decisions and arriving at workable solutions which can be implemented remotely at short notice is required;
  • Experience in appearing before a court in an official capacity and involvement with the drafting of submissions to a court is desirable;
  • Work experience in a conflict or post conflict context is desirable.

 

Knowledge, Skills and Abilities:

  • Excellent leadership, people management, negotiation and organisational skills;
  • Ability to conduct oversight and supervision of operations;
  • Ability to deal effectively with victims and witnesses in stressful situations, particularly those who have suffered trauma;
  • Ability to initiate, develop and effectively manage both internal and external relationships at operational level in matters relevant to the victims/witnesses protection, support and other assistance;
  • Knowledge of the legal framework of the Court;
  • Cultural and gender sensitivity and ability to work and operate in a multicultural environment;
  • Absolute integrity, tact, sensitivity, discretion and good judgment, including particular sensitivity to the needs of victims of sexual violence, children, the elderly and the disabled;
  • Excellent written and verbal communication skills with keen attention to details.

 

Knowledge of Languages:

Proficiency in one of the working languages of the Court, French or English, is required. Working knowledge of the other is desired. Knowledge of another official language of the Court (Arabic, Chinese, Russian and Spanish) would be considered an asset.
