Senegal: Jurist in Environment -WEEE Management Consultant

 

The objective of this assignment is to support the Department of the Environment and Classified Establishments in the process of reviewing the draft decree on the organization of WEEE management and to support the project team in the validation and signature process.  The objective is to improve the draft decree, to bring the stakeholders to a convergence of views, to integrate the concerns of the different actors of the WEEE sector.

(a) Revise the draft decree on the organization of WEEE management: This process has already been initiated by ADIE in collaboration with the Permanent Consultative Committee (CCP) chaired by the Secretary General of the Government and whose secretariat is provided by the Minister in charge of the Environment.

(b) Elaborate a decree relating to the management of WEEE: This task will be carried out by the consultant. the objective is to set, in application of the provisions of the Environment Code, the conditions and modalities of management ecologically rational waste from electrical and electronic equipment, to protect the environment and human health.

 

Project Background and Objectives

 

A.1.1. Background

The report presenting this draft decree on the organization of the management of waste electrical and electronic equipment (WEEE) indicates that "the issue of WEEE was not specifically taken into account by Law 2001-01 of January 15, 2001 on Senegal's Environmental Code. The same presentation report states that "because of their composition in heavy metals and precious and recoverable elements, many informal activities are carried out around the management of WEEE. The eco-toxicological, socioeconomic and environmental challenges of the said waste reinforce the need for a framework for its management, ...

The purpose of this draft decree, which is intended to supplement Act No. 2001-01 of January 15, 2001 on the Environmental Code and its implementing decree No. 2001-282 of April 12, 2001, is to set :

      • the organizational, functional and financial framework of the management of WEEE in Senegal;
      • the collection and transport of WEEE;
      • the terms and conditions for issuing authorization to open specialized facilities;
      • the storage, dismantling, treatment with a view to recovery, disposal of WEEE or any other related activity;
      • authorizations for the import and export of electrical and electronic equipment or their by-products".  
      • the establishment of an eco-organization for the environmentally sound management of WEEE

This draft decree is a step forward compared to the current situation. Indeed, it completes and fills a legal void left by the aforementioned 2001 Environmental Code currently in force.

However, some of its provisions are problematic. In particular, this is the case for all that concerns the organization and operation of the eco-organism which needs to be better adapted to international legislation and practice in this area. Indeed, an eco-organism is :

      • a non-profit structure approved and entrusted with a mission of general interest by the public authorities in the framework of extended producer responsibility (EPR) to set up and finance the recovery of products placed on the market once they have reached the end of their life;
      • a tool enabling producers and importers to fulfill their removal and processing obligations in return for a financial contribution ;
      • an expert coordinating a collection network and having qualified service providers, in this case private sector actors, ensure the removal and treatment of waste, with a permanent concern for the environment;
      • an interlocutor who listens to the various stakeholders, i.e. public authorities, producers, distributors, consumers, social and solidarity economy players, associations, etc., whose role is to create a waste management system that respects the three pillars of sustainable development (economic, social, environmental).

In addition, the institutional implementation of the text after discussions between the Ministry of the Environment and Sustainable Development (MEDD) and the State IT Agency (ADIE), which initiated it, has been handed over to the MEDD. Indeed, the waste from computer equipment that seems to legitimize the positioning of ADIE in this process is indeed part of the waste from electrical and electronic equipment (category 6). However, waste from electrical and electronic equipment is not limited to waste from computer equipment. They encompass broader and more diverse categories of waste (seven (7) categories). It should be noted that despite the involvement of the environmental department and the classified establishments in the process of drafting this text, it must be acknowledged that there is still a problem of appropriation of the process by the Ministry of the Environment at the highest level. The necessary reporting to the decision-making authorities would not have been made. A constructive dialogue has been initiated to overcome this situation. 

 

A.1.2. Institutional arrangements

Regarding WEEE management, the Government body in charge of technical and operational management is ADIE. Therefore, GGGI has signed a Memorandum of Understanding (MoU) to formalize a framework of cooperation and to facilitate collaboration between the Parties to promote programs, projects, policy interventions and other necessary joint activities in promoting the application of improved sanitation through supporting public awareness and development of WEEE solutions, including capacity enhancement. For that purpose, a focal point has been designated by ADIE to ensure alignment of the project’s findings with the Government’s priorities.

GGGI has also built partnership with non-government entities, namely Regional Center of the Basel and Stockholm Conventions for Francophone African countries (CRCBS-AF), to joint efforts for more effective and impactful actions.

A constructive dialogue has been initiated to overcome the institutional constraints on the draft decree. Through the involvement of the Environment Directorate and the classified establishments in the process of drafting this text, the Ministry of the Environment has taken over the leadership for an appropriation of the process by the Ministry of the Environment at the highest level. The necessary reporting to the decision-making authorities was made.

 

A.1.3. Project Objectives 

The “Green Secondary Cities Wastewater, Plastic Waste and WEEE Management through Innovative Business Model for Recycling and Valorization” Project objective is to support Senegal’s efforts to achieve integrated and environmentally sustainable waste management and accelerate green secondary city development. The project will improve the living conditions of the populations of Dakar, Tivaouane and Touba through a range of innovative interventions in waste management. The project will focus on three dimensions: i) plastic waste management Touba; ii) waste from electrical and electronic equipment (WEEE)management in Dakar; and iii) wastewater management in Tivaouane. The project is designed according to a systemic approach working with all steps of the whole waste value chain and considering the economic, environmental, social and institutional dimensions.

This project is funded by the Ministry of Environment, Climate and Sustainable Development of The Grand Duchy of Luxembourg.  GGGI’s Government Partners in implementing the Project components are:

      • Plastic waste Component: The Waste Management Coordination Unit (UCG) of the Ministry of Urban planning, Housing and Architecture;
      • E-waste Component: The Government IT Agency (ADIE) of the Ministry of Digital Economy and Telecommunication;
      • Wastewater Component: The National Office of Sanitation (ONAS) of the Ministry of Water and Sanitation.

This second component of the project aims to improve WEEE management value chain the city of  Dakar through the setting up of an eco-organism and the development of sustainable Public-Private-Partnership business models for treatment and valorization.

Specific goals pursued through this component are:

      • Development of a roadmap for the WEEE management chain in Senegal.
      • Revision, validation and signature of the Decree on the organization of the management of waste electrical and electronic equipment in Senegal.
      • Provide technical assistance for the implementation of the eco-organism.
      • Develop an exchange platform to improve communication between actors (collectors, repairers, treatment organization, end users of parts and WEEE, etc.).
      • Strengthen the capacities of actors on management and standard dismantling techniques (informal actors, institutional partners) on best practices, WEEE management policies, formalization, business management, fundraising, etc.).
      • Develop a GGGI program in schools to build the capacity of groups of young people and future stakeholders on the health, economic and environmental issues of WEEE.
      • Conduct an awareness-raising campaign among communities and service providers to improve collective and individual WEEE management behaviors.

 

A.1.4. Presentation of the City of Dakar and WEEEM analysis

Senegal has experienced a rapid pace of urbanization. More than 45% of the total population of 15.3 million currently live in urban areas. With an annual increase of nearly 2.5%, by 2025, 62% of Senegalese will probably live in cities. This means 13.5 million urban dwellers in 2025, more than 13 times more than in 1960. This rapid pace of urbanization severely impacts the ability of municipalities to effectively provide and manage basic urban services. Senegal's economy is largely driven by urban centers, particularly the capital Dakar. 65% of Senegal's GDP is produced in urban centers and 55% in Dakar in particular. 80% of registered companies are located in the greater Dakar metropolitan area. Most jobs are created in Dakar (more than 52%) and 62% of business openings take place in the capital. Currently, in most cities in Senegal, the components of the WEEE management system for collection, dismantling and treatment are neglected.  Solutions do not include waste recovery. One of the dimensions of this project is to better understand and propose solutions to these challenges.

 

The tonnages put on the market are increasing, in line with the continuous growth of the GDP. Proportionally, it is category 3 (lamps) that is progressing the most with more than 4,900 Tons that will be put on the market in 2030 (for 86 Tons in 2005 and about 1,100 Tons in 2019).

 

However, it is category 5 (small equipment) which represents the largest share of EEEs placed on the market, with category 1 (heat exchange equipment). These 2 categories represent around 70% of the tonnages placed on the market (69% in 2019 and 72% in 2030).

 

The quantities placed on the market in category 6 represent more than 3,000 tons in 2019 and double by 2030 with more than 6,000 tons placed on the market.

 

The main WEEE deposit corresponds to category 5. This category includes all EEE used in particular by households and not included in the other categories.

Between 2019 and 2030, the deposit of WEEE is multiplied by 2.5. It increases from 17,000 to 43,000 tons for all categories combined. The deposit of WEEE category 5 (small equipment) represents nearly half of the deposit.

 

B. Logistic services provided by GGGI

GGGI will provide documentation, facilitate the connection with partners, and make the Microsoft Teams platform available for virtual workshops to share study results in appropriate formats.

 

Travel Expenses

(a) If the Individual Consultant does not reside in the Duty Station prior to the commencement of the Services, GGGI shall provide the cost of travel, for the Individual Consultant only, to and from the Duty Station upon commencement and expiry of this Contract, in an amount determined by GGGI in accordance with its travel policy and guidelines, as then in effect.

 

(b) If the Individual Consultant is required by GGGI to travel on official business to a location(s) other than the Individual Consultant’s Duty Station during the period specified in Article 2 of the Contract then, upon prior written approval by GGGI, such travel shall be at the expense of GGGI in accordance with GGGI’s travel policy and guidelines, as then in effect.

 

C. Deliverables

The expected outputs are as follows (however, the Consultant may be required to produce additional output(s) as deemed reasonably necessary by GGGI) :

      • Inception Report ;
      • Assessment of the roles and responsibilities of the main actors in the WEEE value chain ;
      • Assessment of existing regulations and initiatives in the area of WEEE management ;
      • Revision of the draft decree on the organization of WEEE management in Senegal ;
      • Proposal of validation and signature process of the Decree on the organization of WEEE in Senegal ;
      • Proceedings of consultation meetings, virtual workshops and key stakeholder consultation workshops ;
      • Monthly progress report and work plan ;
      • Draft of the revised draft Decree on the organization of the management of WEEE ;
      • Final report : validated version to be submitted for signature.

All reports and outputs must be in French and English, in accordance with GGGI’s formatting requirements, and submitted in electronic formats along with complete sets of raw data, research materials, and interview notes. For each report, the Consultant shall provide a PPT file. The Consultant work progress will be monitored primarily through periodic review meetings. The Consultant is also expected to periodically produce, upon GGGI’s request, a formal progress report that includes: an overview of the project, a narrative description of project activities, detailed information on project objectives and milestones, actual achievements made against the timeline set, etc. The Consultant is expected to deliver following outputs in accordance to the timeline and payment schedule below:

D. Suggested methodology and competence requirements

The consultant will define together with the WEEE expert and the focal point within the DEEC the best methodological approach to support the efficient and timely realization of the various commitments and products in which he is involved. This will be reflected in the proposed work plan. The consultant shall demonstrate the competencies described below.

 

E. Qualifications & Expertise
      • Advanced degree in environmental law, environmental sciences and/or any other relevant field, with at least 10 years of professional experience in the field of environmental jurisdiction.
      • a proven track record and competence in the development of regulatory texts ;
      • proven experience in the value chain in the management of WEEE ;
      • proven experience in the management and operation of eco-organizations;
      • Good Knowledge of Green Growth Challenges;
      • Proven experience on Green City Development approach;
      • Knowledge of the Senegal development challenges of and stakeholder network;
      • Analytical skills, critical thinking ability, and quantitative skills;
      • Strong communication  skills both in written and speaking
      • Ability to develop powerful presentations

 

Additional Information
