Vietnam Consultant - Legal Advisory, AFOLU Sector Project



Based in Seoul, The Global Green Growth Institute (GGGI) is an intergovernmental organization founded to support and promote a model of economic growth known as "green growth", which targets key aspects of economic performance such a poverty reduction, job creation, social inclusion, and environmental sustainability. GGGI works with countries around the world, building their capacity and working collaboratively on green growth policies that can impact the lives of millions. The organization partners with countries, multilateral institutions, government bodies, and private sector to help build economies that grow strongly and are more efficient and sustainable in the use of natural resources, less carbon intensive, and more resilient to climate change.

GGGI Vietnam is currently working on investment plans aligned with national and sub-national climate strategies to support private investments in strategic areas of the AFOLU sector (hereinafter “the investment opportunities”) including the following typology: long rotation cycle timber plantations, coffee and/or fruit and nut agroforestry systems, and alternative wetting and drying (AWD) rice agricultural systems.  

A number of antecedent conditions that hamper private investment in these areas (hereinafter “the antecedent conditions”) include incomplete or incompatible land use planning, farmland atomization, absence of green credit and incomplete decentralization (not achieved equally among provinces).

Objectives/Purpose of the Assignment


The purpose of the assignment is to conduct a legal and institutional analysis of the AFOLU sector including: policy gap analysis for investments identified (long rotation cycle timber plantations, coffee and/or fruit and nut agroforestry systems, and alternative wetting and drying (AWD) rice agricultural systems.); policy changes/levers to incentivize adoption of specified investments; and steps and priority actions for policy change. The legal and institutional analysis of the AFOLU sector will serve for the development of the Action Plan, identifying policy-based solutions for “the antecedent conditions”


Scope of Work


The consultant will:

1)     Identify, collate, and systematize previous analyses on the matter of the consultancy.

2)     Develop legal and institutional analysis focusing on the aspects of the public sector framework that act as barriers for the prioritized investments.

3)     Develop a policy gap analysis in structural, national/subnational and sector-specific legal framework, as well as at the constitutional/collective-choice/operational level.

4)     Identify applicable policy amendments and levers to incentivize adoption of the identified investments (following the rules of public management for policy change). Proposed policy amendments need to be justified and feasible within the National Legal Framework. The scope, steps, and expected impacts of policy amendments should be clearly defined.

5)     Co-organize and participate in public consultation events with the MSWG to present and receive feedback on the products of the consultancy

6)     Develop knowledge-sharing materials on the results of the consultancy, to be delivered to public sector officials through capacity building activities.

7)     Co-organize and participate in capacity building activities for public sector officials.


A Multi Stakeholder Working Group (MSWG) will be convened to validate the antecedent conditions and support the identification of the institutional analysis. The consultant will engage with the MSWG (in Vietnamese language) through an iterative process to discuss and validate the antecedent conditions, present and discuss drafts, and validate the final proposed policy changes.  Consultations with MSWG will be done through a combination of virtual and presential meetings.

The consultant will provide and receive inputs as part of the GGGI team of technical experts in charge of developing the Action Plan.  The reports described in the deliverables section need to reflect the inputs from GGGI Team and the MSWG.


Output/Reporting Requirements/Deliverables


The expected outputs for this activity are:

Inception report: due on June 15th 2021 (10% of total payment)

First Draft Legal Report: due on July 14th 2021 (15% of the total payment)

Second Draft Legal Report: due on August 4th 2021 (25% of the total payment)

Final Legal Report: due on September 25th 2021 (50% of the total payment)


Deliverables will be reviewed based on Pass/Fail Criteria.

The consultant will report to GGGI-Vietnam Country Representative and Project Manager.

All reports must be in English and submitted in hard copy and electronic formats (Word, PFD and PowerPoint presentation) along with interview notes or research materials if any.




The consultant should have 10 years of relevant experience in legal and policy disciplines in the public sector with a master’s degree in  Public Sector Law/environmental Law/Forest Law, or equivalent combination of relevant education and experience.

The consultant should be able to apply policy frameworks to assess the requirements of the project; providing substantive input through the reports; interacting with different stakeholders in order to facilitate the assessment of needs and the provision of services which meet the expectations; and managing the deliverables according to the time established. Analytical work should be effectively organized and delivered within the established resources.
