FACILITATOR(S) FOR THE 2ND ANNUAL TRIBUNALS’ SYMPOSIUM, 2021

BACKGROUND

The office of the Registrar of Tribunals was established in April 2017 by the Judicial Service Commission (JSC), to coordinate the affairs of the Tribunals that had transitioned into the Judiciary. Currently, there are over 50 Tribunals established under different Acts of Parliament. Article 1 (3) of the Constitution recognizes the Judiciary and independent Tribunals as state organs to which sovereign power of the people of Kenya is delegated. Additionally, Article 169 (1) defines subordinate courts to include local Tribunals as may be established by an Act of parliament. Currently, there are 17 Tribunals administered under the Judiciary in accordance with the Constitution and upon Treasury alignment of tribunals.

THE ASSIGNMENT

The Office of the Registrar Tribunals in collaboration with Judiciary Training Institute (JTI) and with support from  IDLO has organized the 2nd Annual Tribunals Symposium in Mombasa, from 27th June to 1st July 2021. The objective of the symposium is to create platforms to bring together all the Tribunals under the Judiciary for the purposes of cross-learning, sharing knowledge and experiences in the running of Tribunals, to enhance Access to Justice.  

IDLO and the Office of the Registrar Tribunals seek to engage external facilitators to moderate sessions and lead panel discussions on various issues as they relate to the operations of Tribunals. The facilitator/moderator’s role will be to guide discussions through engaging the panelists on the topics at hand, asking relevant follow on questions, seeking to clarify issues, and managing the plenary discussions. The topics include:

  • Understanding Tribunals in Kenya
  • Achievements, challenges, and opportunities for enhanced access to justice through Tribunals 
  • New innovations in Tribunals processes in the context of Covid19 (Automating Tribunal processes)
  • Integration of Tribunals into Judicial processes 
  • Best practices in dispute resolutions by the tribunals

DELIVERABLES 

The Consultants shall deliver the following: 

a) An Inception report that demonstrates an understanding of the theme of the symposium and how the assigned topics fit into the theme, including how the consultant will facilitate an assigned session in meeting the symposium theme.

b) A PowerPoint presentation on the topics allocated to the Consultant to be submitted to IDLO and the Office of the Registrar Tribunals before the symposium.

c) A consultant’s consolidated report of the proceedings and feedback drawn from the thematic discussions with the participants during the symposium.

DURATION OF THE ASSIGNMENT 

The assignment will be undertaken over a 3 days period from 28th to 30th June 2021. The assignment is output based and flexibility of scheduling and availability might be required to ensure completion of work during the time frame. 

IDEAL CANDIDATE PROFILE 

The Consultant(s) should have the following skills, qualification, and experience: 

Education

  • A Bachelor’s Degree in Law from a recognized and reputable university
  • An Advocate of the High Court of Kenya with not less than 10 years post-admission experience
  • A Master’s degree in Law is an added advantage
  • Certification as a Public Arbitrator/Mediator  

Work experience

  • Demonstrate knowledge of the Judiciary’s and administration of justice work 
  • Knowledge of Tribunals and their mandates
  • Experience in working with Tribunals is an added advantage

Technical competencies 

  • Excellent organizational, interpersonal, and communication skills
  • Excellent work ethic founded on the principles of integrity, impartiality, and confidentiality
  • Professionalism in the process of engaging with IDLO, The Office of Registrar Tribunals, Judicial Training Institute, and training participants

REMUNERATION FOR THE ASSIGNMENT

The Consultant shall receive a lump-sum consultancy fee at the market rate, upon satisfaction of all the deliverables.  All fees are subject to a 5% KRA withholding tax.

REPORTING AND SUPERVISION 

The Consultant shall report directly to the Registrar - Tribunals and the Field Programme Manager  - Access to Justice at IDLO, Kenya respectively.
