Background

UN Women plays an innovative and catalytic role in the State of Palestine since its inception in 1997. UN Women Palestine Office focuses its activities on one overarching goal, namely, to support the implementation at the national level of existing international commitments to advance gender equality in line with the national priorities. In support of this goal, and thoroughly taking into consideration the specificities of the Palestinian context, UN Women concentrates its efforts and interventions toward the realisation of following strategic goals:  Mainstreaming gender in governance, peace and security; Supporting women's economic security and rights; and Promoting women’s rights and protection against violence.

In line with the Palestinian Government’s commitment to  achieve gender equality and to fight Violence Against Women (VAW), and in full partnership with the Justice, Security and Social Sectors, including the Public Prosecution (PP), the Palestinian Civil Police (PCP), the Ministry of Social Development (MoSD), the High Judicial Council (HJC) and the Supreme Judge Department (SJD), UN Women, within its joint programme with UNDP and UNICEF- “Promoting the Rule of Law in Palestine- SAWASYA II” is supporting the Justice, Social and Security institutes to mainstream gender into  their procedures and policies, and develop and provide  gender responsive services to women victims and survivors of violence, through providing institutional capacity building and policy level interventions  amongst others.

On 9 March 2022 the VAW court in Nablus has been inaugurated, to form the first of its kind in Palestine. This has marked a milestone for the justice sector and has put responsibilities on the HJC to deliver and ensure gender responsive court services to women victims and survivors of violence. To support the HJC in successfully implementing this important task, UN Women within SAWASYA II programme and in full collaboration and coordination with the HJC and Nablus Court, plans to recruit a national consultant to monitor and document the piloting phase (six months) of the VAW court, to ensure the availability of evidence-based lessons learned; and identify gaps, challenges, opportunities and best practices.

 

Objectives of the assignment:

The ultimate goal of this assignment is to support the HJC to improve the provision of court services to women victims and survivors of violence; strengthen the institutionalization of the VAW judiciary, contribute to the learning process of the HJC and SAWASYA II programme, and to support the effective replication of this experience in other governorates.

More specifically, the assignment seeks to achieve the following two objectives:

  • To monitor the provision of court services provided to women victims and survivors of violence at the Nablus VAW court. The monitoring should be guided by gender justice standards and best practices, including CEDAW General Recommendation 33 on access to justice.  It should include observation, collection and documentation of women’s experience in the Nablus VAW court; covering aspects related to privacy and confidentiality of cases, safety of women victims and survivors of violence, coordination between service providers, and efficiency of services. It should also include collection of data on the level of satisfaction of women beneficiaries of services, taking into consideration research ethics, including privacy and confidentiality of collected data, informed consent of women interviewees, ‘do no harm’ principle, amongothers.
  • To produce an analytical report that captures the lessons learned, best practices, gaps, challenges and opportunities. The report should also include a set of actionable recommendations to improve the quality of services; address the challenges and gaps; and seize opportunities.

Duties and Responsibilities

Under the overall guidance of the UN Women Special Representative in the State of Palestine, the direct supervision of UN Women Sawasya Programme Specialist, and working in close cooperation and coordination with the HJC Gender Unit, and Nablus Court Chief Judge, the Consultant will undertake the following tasks, duties, and responsibilities:

1. Develop an inception report that includes the work plan, the methodological framework, including the tools that will be used to collect data, the monitoring reporting template, the satisfaction assessment template, and the timeline for the deliverables, to be approved by UN Women, following a consultation process with relevant actors. The methodology should notably consider the following tools, amongst others:

  • Direct observation
  • Bilateral and multilateral meetings with stakeholders, including VAW judges, VAW prosecutors, social counsellor, and others.
  • The development of a questionnaire to solicit the opinions of women beneficiaries of services, and their level of satisfaction.

As part of the methodology, the consultant shall develop a set of questions that the monitoring report will look at and answer, a set of indicators, including their definitions, and a monitoring, evaluation, accountability and learning plan (MEAL), which will form the basis of the monitoring report that will be produced under this assignment.

2. Monitor the piloting phase of the Nablus VAW court:

  • Observe, and collect data on the provision of services provided to women beneficiaries -; the level of alignment with international standards and gender justice best practices, including amongst others; safety, security, privacy and confidentiality of cases; the level of efficiency of services, and effectiveness of coordination between service providers.
  • Collect and analyze data on the level of satisfaction of women beneficiaries of services.
  • Solicit opinions and views of service providers involved in the work at Nablus Court, capturing good practices, challenges, gaps and opportunities.
  • Conduct meetings with decision makers involved in the work of Nablus Court, notably Nablus Court Chief Judge, VAW judges and the Head of the Gender Unit to update them on regular basis on the assignment and solicit their views and suggestions.

3. Submit a progress and a final monitoring reports:  

  • Develop and submit a progress monitoring report covering the period of three months.  The report should provide an update on the progress of the assignment, including the main observations; key highlights about main challenges, gaps, and if needed an amended methodology, and submit for UN Women’s review and approval.
  • Develop and submit a final monitoring report. The report should include an executive summary; list of contents; the methodology that was used, the main observations, key lessons learned, challenges, gaps, opportunities, key actionable recommendations and others as relevant. The report should also include an assessment on the level of satisfaction of women beneficiaries of services; the list of service providers and/or decision makers interviewed, the filled questionnaires, and other related raw data such as minutes of meetings and others.

Deliverables: 

  • Deliverable 1: Inception report, including the methodological framework and the work plan. (Expected delivery date: 2 weeks after the signing of the contract)
  • Deliverable 2: An approved progress report. (Expected delivery date: 4 months after the signing of the contract, covering the period of 3 months).
  • Deliverable 3: A final approved monitoring report. (Expected delivery date: 7 months after the signing of the contract, covering the whole monitoring period- 6 months)

Required Skills and Experience

Education:

  • A BA degree in Social Studies, Gender Studies, Criminology, Law, or any other related field. A Masters degree is an asset.  

Experience:

  • At least five years professional experience in the field of VAW, and gender justice.
  • Minimum five years of relevant work experience in the field of monitoring and evaluation.
  • Court monitoring experience, or an experience with the justice system is an asse.
  • Experience with the UN system or/ and International Organizations is considered an asset.

Language Requirements:

  • Professional knowledge of English, and fluency in Arabic

Evaluation of applicants

Candidates will be evaluated using a cumulative analysis method taking into consideration the combination of the applicants’ qualifications mentioned above, and financial proposal. A contract will be awarded to the individual consultant whose offer receives the highest score out of below defined technical and financial criteria. Only candidates obtaining a minimum of 50  points in the technical evaluation will be considered for an interview. Technical Evaluation (60%) – max. 60 points:

  • A BA degree in Social Studies, Gender Studies, Criminology, or any other related field. A Masters degree is an asset. (max.10 points)
  • At least five years professional experience in the field of VAW, and gender justice. (max. 15 points).
  • Minimum five years of relevant work experience in the field of monitoring and evaluation. Court monitoring experience, or an experience with the justice system is an asse.  (max. 20 points).
  • Experience with the UN system or/ and International Organizations is considered an asset. (max. 5 points).
  • A sample of a monitoring report and a MEAL plan. (max. 10 points)
  • Technical interview (max. 10 points)

Financial Evaluation (30%) – max. 30 points.

Only candidates obtaining a minimum of 50 points in the technical evaluation will be requested to provide a financial proposal. The financial proposal shall specify a total lump sum amount breaking down a daily professional fee, proposed number of working days and any related expenses, i.e. travel and communications expenses.

The maximum number of points assigned to the financial proposal is allocated to the lowest price proposal. All other price proposals receive points in inverse proportion. A suggested formula is as follows:

p = 30 (µ/z)

µ = price of the lowest priced proposal

z = price of the proposal being evaluated
