National Expert to develop Guidelines on shifting of the burden of proof (SSA)

Background:

The Mission will continue the support of the host country in the implementation of the Ohrid Framework Agreement, by inter alia assisting the country in creation of effective regulatory and institutional framework in the field of tolerance, equal treatment and non-discrimination. As per the project “Strengthening the rule of law and human rights in North Macedonia II”, the Mission will assist the Commission for Prevention and Protection from Discrimination (CPPD) to develop its strategic thinking and documents.
An important change introduced in the new Law on Prevention and Protection from Discrimination was to shift the burden of proof to the alleged discriminator, i.e. for them to prove that the discrimination did not occur. With the aim to enable the CPPD to properly assess the cases and effectively implement the legislation, the Mission will support the CPPD by engaging a National Expert to develop step-by-step guidelines for applying this provision uniformly, in cases brought before the Commission.
 

Tasks and Responsibilities:

Under the supervision of the OSCE Anti-discrimination Portfolio Manager, the national expert will be responsible for the following:

1.    To coordinate the work with the CPPD by organizing at least 2 meetings jointly with the Mission;
2.    To develop the content of the new Guidelines on shifting of the burden of proof, predominantly on the basis of desk research;
3.    To facilitate at least one expert debate for discussing the content of the Guidelines with expert audience;
4.    To regularly coordinate with the OSCE Anti-discrimination Portfolio Manager and the CPPD.
 


Deliverables:
 

  • Working Plan subject to approval of the OSCE Anti-Discrimination Portfolio Manager by 05 July 2022;
  • Draft content for the new Guidelines on shifting of the burden of proof by 15 September 2022; 
  • Conclusions from the expert debate by 30 September 2022; and
  • Final content of the new Guidelines on shifting of the burden of proof by 15 October 2022.

 

Necessary Qualifications:

 

  • Citizenship of or permanent residence in the Republic of North Macedonia;
  • First-level university degree in law, social sciences or human rights or equivalent experience in Human Rights;
  • At least six years of relevant work experience in the area of human rights, equality, legal drafting and research;
  • Proven knowledge in the field of anti-discrimination and equality, including gender equality;
  • Proven knowledge of EU anti-discrimination law and national judicial and quasi-judicial practice in the area of anti-discrimination;
  • Excellent written and oral communication skills, advanced legal drafting skills and great organization skills; 
  • Previous experience in drafting legal text and analysis;
  • Ability to work with minimum supervision;
  • Fluency in Macedonian and English language, spoken and written;
  • Computer literacy;
  • Demonstrated gender awareness and sensitivity, and an ability to integrate a gender perspective into tasks and activities.
     

Remuneration Package:

For the services provided, the National Expert will be remunerated at the rate of 100 EUR per day, for a total of up to 20 consultancy days, in total 2000 EUR. Payment will be made upon successful completion of all tasks and responsibilities, as per the Terms of Reference.

The foreseen period of engagement will be from July to October 2022.
