Terms of Reference

A legal aid expert will be part of the LAAF team and be responsible to lead the LAAF process and results. The legal aid expert will work closely with the UNHCR and with the core group of agencies supporting the LAAF exercise. The legal aid expert will interact with relevant stakeholders for the collection of available data and information, assist in liaison with national authorities and civil society actors. The legal aid expert can assist with designing additional tools, if relevant. The legal aid expert has an important role in ensuring smooth interaction among the core group of agencies, including planning of sufficient time for meetings and adhering to protocol, access to information, and national ownership of the assessment.

Duties and responsibilities:

Under the direct supervision of the Protection Officer at UNHCR in Iraq and in collaboration with the project Steering Committee composed by the core group of agencies supporting the LAAF exercise, the consultant will produce the following deliverables and perform the following tasks according to the agreed upon timeline:

- Inception Report:  the legal aid expert will conduct a desk review on existing data and information on legal aid and justice legislative and policy framework, legal aid needs of people residing in Iraq, identifying remaining obstacles to access justice. The desk review will include an initial mapping of existing capacities and responses to tackle legal aid needs.
LAAF Process: The legal aid expert will lead the LAAF process and in particular, will:
- Facilitate the kick-off LAAF workshop: the LAAF Team will present inception report to relevant stakeholders, validate the methodology to be used to complement the analysis conducted through the desk review; Conduct KII with relevant stakeholders, including national authorities, civil society actors, international and national development, humanitarian, peace and human rights actors; Facilitate the Validation Workshop: the legal aid expert will facilitate dialogue aimed at drawing analytical conclusions for each pillar of the LAAF; Finalization workshop: the legal aid expert will facilitate dialogue aimed at generating options for coordinated response stemming from the agreed-upon analytical conclusions for each pillar of the LAAF.

- Final LAAF Report: the legal aid expert will draft the LAAF report. The report will include the findings of the desk review, of the KII and of the inputs received during the LAAF process.
Dissemination of the report: the legal aid expert will support the dissemination of the report in coordination with the UNHCR.

- The legal aid expert must ensure the voice and knowledge of the rights holders and of the affected population, local staff, national partners on the ground, and first line workers is at the centre of the analysis. National duty bearers should be consulted and in particular legal aid/justice service providers such as public defenders, lawyers, legal practitioners, paralegals, legal aid clinic/centers staff, community/traditional/religious leaders.

- The UNHCR will lead the coordination of the LAAF rollout.  UNHCR will support the legal aid expert in the identification of relevant stakeholders interested in co-implementing the process and ensure smooth collaboration throughout. UNHCR will ensure technical and qualitative review of the deliverables produced by the legal aid expert as well as smooth information management.

Essential minimum qualifications and professional experience required
Education: University degree in law, international relations, humanities/other related degree, with possible specialization in international human rights law or international humanitarian law

Experience: Minimum 6 years of previous experience working in a humanitarian / recovery context and previous experience working from within technical expertise area (legal aid) Documented results related to the position’s responsibilities

Competencies: In depth knowledge of legal aid work in humanitarian settings and understanding of humanitarian coordination structures; Excellent analytical skills, including the capacity to collect and analyse qualitative and quantitative data from various sources to produce meaningful analysis for strategic planning, programming, advocacy and other needs.

Demonstrated organizational skills: the ability to work independently and productively in a fast-paced environment.
Flexible work attitude: the ability to work productively, independently, and to handle requests or issues as they arise.

Excellent interpersonal and communication (including drafting) skills: the ability to successfully and effectively communicate with people in a multicultural environment. Excellent computer skills.

Languages: Excellent knowledge of English and Arabic is required.
