National Consultancy on Modeling Diversionary Measures for Children in Conflict with Law

The scope of work for the national consultancy is mainly focused on supporting the international expert and the partners from the Ministry of Interior and Prosecutor General’s Office in establishing child-friendly procedures and modelling diversionary measures for children in contact with the law. The main objectives of the consultancy are: 1. Promotion of further amendments on justice for children to the Criminal and Civic Codes 2. Development of child-friendly procedures for children in contact with the law 3. Modelling of a diversion with a restorative justice approach for cases of juvenile offenders. The consultancy is planned within the German Funds in line with the work plans of UNICEF, the Ministry of Interior (MOI) and the Prosecutor General’s Office (PGO) as the necessary initiative to develop and implement in the context of Turkmenistan in 2023.

Currently, Turkmenistan is going through some reform processes across rule of law and justice area, including juvenile justice. Turkmenistan’s vision of juvenile justice system reform was presented in the ‘General Programme on Development of Juvenile Justice System for 2012-2016’, and a number of Decrees and Resolutions were adopted in the period 2016-2020. The assessment of the Programme recommended the Government for further effort with regard to the development of community-based services for diversion, rehabilitation and reintegration of children in conflict with the law, as well developing a procedural framework that would create a child-friendly approach toward victims and witnesses of crime at any stage during the formal investigation process.
 
In 2023, the Prosecutor General’s Office formally agreed to lead the advocacy of Modelling Diversion with Restorative Justice, which is the first of its kind in Turkmenistan. UNICEF will introduce the justice sector partners to best practices on diversionary measures and support the Prosecutor General’s Office to draft the Concept of Diversion with a Restorative Justice approach to be launched in 2023. This initiative further requires UNICEF’s technical support, both – international and national experts in modelling at the level of one district or countrywide in line with international juvenile justice standards this year

Main Tasks Related to the Job

It is expected that, in the given timeframe, the national consultant will perform the following tasks and deliverables to achieve the objectives of the assignments

1. Promotion and development of further amendments on J4C to the Criminal and Civic legislation

2. Development of child-friendly procedures for children in contact with the law

3. Modelling of a diversion with a restorative justice approach for cases of juvenile offenders

Education

  • University degree in law or other related social sciences

Skills and experience 

At least 5 years of professional experience in the government in the field of child rights and justice for children,
▪ Knowledge of international instruments and standards related to child rights and justice for children,
▪ Experience in developing laws and by-laws related to child rights and justice for children in other countries,
▪ Excellent analytical and report-writing skills,
▪ Excellent presentation and communication skills,
▪ Excellent written and spoken command of Russian and Turkmen languages, English will be an asset

Individuals engaged under a consultancy or individual contract will not be considered “staff members” under the Staff Regulations and Rules of the United Nations and UNICEF’s policies and procedures, and will not be entitled to benefits provided therein (such as leave entitlements and medical insurance coverage). Their conditions of service will be governed by their contract and the General Conditions of Contracts for the Services of Consultants and Individual Contractors. Consultants and individual contractors are responsible for determining their tax liabilities and for the payment of any taxes and/or duties, in accordance with local or other applicable laws. 

The selected candidate is solely responsible to ensure that the visa (applicable) and health insurance required to perform the duties of the contract are valid for the entire period of the contract. Selected candidates are subject to confirmation of fully-vaccinated status against SARS-CoV-2 (Covid-19) with a World Health Organization (WHO)-endorsed vaccine, which must be met prior to taking up the assignment. It does not apply to consultants who will work remotely and are not expected to work on or visit UNICEF premises, programme delivery locations or directly interact with communities UNICEF works with, nor to travel to perform functions for UNICEF for the duration of their consultancy contracts.
