Background

1. Background

A priority task of the Cabinet of Ministers of Ukraine in the field of administrative services’ development and their digitization is to ensure the provision of public services in electronic form.

One of the vulnerable categories of Ukrainian citizens, on whom, in particular, the implementation of digital solutions is aimed, are persons affected by the military invasion of Ukraine by the Russian Federation.

In the difficult conditions in which the state found itself after February 24, 2022, the Ministry of Social Policy of Ukraine (MSP) implements tasks related to ensuring uninterrupted access of social sphere institutions to digital tools that ensure appointment, accrual, and payment of social benefits to vulnerable sections of the population, including internally displaced persons, and updating of information systems, the holder of which is the MSP, in accordance with the new realities of functioning in the conditions of a full-scale war in Ukraine.

On the initiative of the MSP, the SoE "IOC of the Ministry of Social Policy of Ukraine" developed the platform for providing humanitarian aid to the population, which suffered from the war - " eDopomoga". In the conditions of a significant increase in the burden on the social sphere in connection with the war (multiple increase of IDPs, implementation of new amendments in terms of cash assistance payments, provision of accruals and payments of cash benefits under operating conditions in district-oriented model when part of the territories are occupied) the MSP not only did not stop the development and implementation of the centralized system Unified information system of social sphere (UISSS), but also develops and implements new approaches and optimizes business processes regarding provision of social guarantees to citizens of Ukraine.

Due to limited funding of the MSP and significant growth of the volume of tasks and taking into account the need for further development of digital solutions, the MSP approached UNDP with a request to hire experts for a number of assignments related to development of social sphere e-services and information systems. Duties and Responsibilities

2. Objectives of the assignment / Scope of services

To implement high quality portal and user-friendly social services with positive user feedback and good successful use statistics it is necessary to support implementation business analysis tasks on data exchange of Ministry of social policy of Ukraine systems. To implement these tasks UNDP DIA Support Project is looking for consultant for a 6-month assignment.

The main objective of the assignment is business analysis of social services data exchange.

 

3. Measurable outputs of the work assignment/deliverables 

Hence, it is expected that the National consultant to provide business analysis for social services data exchange will deliver the following services (non-exhaustive list):

Analysis of existing and potential data sources that are used or planned to be used by the Ministry of Social Policy to monitor the current state and  effectiveness of programs in the field of social support and their administration processes, creation of the list of data sources that are used by the MSP

 

Expected result: the analytical report (at least, 2 pages) with the list of data sources, consulted with MSP representatives and UNDP.

In 20 working days after signing the contract 

Deliverable #2 

Determining the degree of reliability of each of data sources that are used by the MSP for monitoring and creation of report on degree of reliability data sources that are used by the MSP

 

Expected result: the analytical report (at least, 2 pages) on degree of data sources reliability, consulted with MSP representatives and UNDP.

In 20 working days after acceptance of Deliverable 1 

Deliverable #3 

Analysis and creation of propositions on data processing methods, description of institutions and persons that should be responsible for the collection and processing of data that are used by the MSP

 

Expected result: the analytical report (at least, 2 pages) with the propositions on data processing, consulted with MSP representatives and UNDP.

In 20 working days after acceptance of Deliverable 2

Detailed analysis and description of data collection and updating processes used by the Ministry of Social Policy, providing recommendations on optimizing these processes

 

Expected result: the analytical report (at least, 2 pages) with the description of data collection and updating processes, consulted with MSP representatives and UNDP.

Providing recommendations on optimizing of data collection and updating processes used by the Ministry of Social Policy

Deliverable #6 

Development of concept for data exchange use for the provision of fully automated services/assistance

 

Expected result: the analytical report (at least, 2 pages) with the concept for data exchange use, consulted with MSP representatives and UNDP.

In 20 working days after acceptance of Deliverable 5 

* The consultant should provide his/her proposal regarding the quantity of working days needed for each deliverable, based on the tentative deadlines indicated above, and indicate in the financial proposal amount distribution by deliverable section. 

 

4. Management arrangements  

The National consultant to provide business analysis for social services data exchange will be primarily responsible for achieving the objectives of the assignment. He/ She will be responsible for all personal administrative expenses associated with the assignment.  

 

5. Monitoring requirements / Terms of payment  

The National consultant to provide business analysis for social services data exchange will work under the overall supervision of the DIA Project Manager and will work closely with DIA Support Senior IT Specialist and the MSP. 

All deliverables shall be approved by UNDP in written form through e-mail after consultations with the MSP. No documents should be published or distributed to third parties without the approval of MDT/MSP and/or UNDP. 

All documents should be submitted to the UNDP in electronic form (*.docx, *.xlsx, *.pptx, and *.pdf or other formats accepted by UNDP). The language of the materials and reports is Ukrainian. The analytical paper should be submitted to UNDP for comments and approval.

7. Required experience and qualifications

  • At least university degree (Bachelor’s) in law, public administration or another sphere 
  • At least 2 years of experience as a lawyer or in another legal-related field
  • Experience within overview development of legal acts (at least 2 examples/samples/brief overview to be provided)
  • At least 1 year of experience in social sphere will be an asset (to be clearly specified in applicant’s CV if any)
  • At least 1 year of experience with international legislation will be an asset (to be clearly specified in applicant’s CV if any)
  • Fluent Ukrainian; working knowledge of English will be an asset.

9. Financial Proposal

Lump sum contract

The financial proposal shall specify a total lump sum amount, and payment terms around specific and measurable (qualitative and quantitative) deliverables (please, refer to Section 3 Measurable outputs of the work assignment/deliverables). Payments are based upon output, i.e. upon delivery of the services specified in the TOR. In order to assist the requesting unit in the comparison of financial proposals, the financial proposal will include a breakdown of Cost by Components.

  • Educational background – 10 pts max
    • 10 pts – Master degree or similar in law or public administration.
    • 8 pts – Master degree or similar in other sphere or Bachelor’s degree in law or public administration.
    • 7 pts –Bachelor’s degree in another sphere.
  • Experience as a lawyer or in another legal-related field – 35 pts max
    • 35 pts – 3+ years of experience;
    • 30 pts – at least 2 years of experience;
  • Experience within overview development of legal acts (at least 2 examples/samples/brief overview to be provided)  – 10 pts max
    • 10 pts –5 and more examples/samples/brief overview;
    • 9 pts – 3-4 examples/samples/brief overview;
    • 8 pts – 2 examples/samples/brief overview;
  • Experience in social sphere 5 pts max
    • 5 pts – available experience (at least 1 year);
    • 0 pts – no experience ;
  • Experience with international legislation – 5 pts max
    • 5 pts – available experience (at least 1 year);
    • 0 pts – no experience;
  • Language Skills – 5 pts max
    • 5 pts – Native / fluent Ukrainian. Working knowledge of English;

Maximum available technical score – 70 points

EVALUATION METHOD:

Cumulative analysis

Contract award shall be made to the incumbent whose offer has been evaluated and determined as:

a) responsive/compliant/acceptable, and

b) having received the cumulative highest score out of a pre-determined set of weighted technical and financial criteria specific to the solicitation.

* Technical Criteria weight: 70%

* Financial Criteria weight: 30%

Only candidates obtaining a minimum 70% from the maximum available technical score (49 points) would be considered for the Financial Evaluation

The maximum number of points assigned to the financial proposal is allocated to the lowest price proposal and will equal to 30. All other price proposals will be evaluated and assigned points, as per below formula:

30 points [max points available for financial part] x [lowest of all evaluated offered prices among responsive offers] / [evaluated price].

The proposal obtaining the overall cumulatively highest score after adding the score of the technical proposal and the financial proposal will be considered as the most compliant offer and will be awarded a contract.
