ORGANIZATIONAL SETTING

Executive management is the corporate engine that binds the KAICIID Dialogue Centre together, builds management cohesion, collegiality and cooperation. Key executive management processes are decision-making, information dissemination, intelligence-gathering, and organizational development and learning, and change management. Executive management includes certain organizational functions that need to be independent of the departments. Executive management facilitates and supports the Senior Leadership Team and any other management bodies. Finally, executive management ensures that the Secretary General, the Deputy Secretary General receive all the support they require in the exercise of their responsibilities. 

ROLE

The Legal Adviser is responsible for ensuring that the activities and decisions of the Centre are in full compliance with its legal framework and that the Centre and its staff are protected in all legal aspects. To this end s/he is expected to provide guidance and legal advice on a wide range of multi-disciplinary, complex legal matters arising from the legal framework of the Centre, public international law, public institutional law, supra-national (EU) law, or national law.

The Legal Adviser reports to the Secretary General.

FUNCTIONS

The Legal Adviser:

  • deals with all legal matters involving the Centre and its staff;
  • provides legal advice on a diverse range of matters arising from the interpretation and application of the founding treaties of the Centre, the law and practice of the Centre’s organs, and the instruments promulgated by these organs, including the Code of Conduct, the Staff Regulations and Rules, the Financial Regulations and Rules, and the related policies, procedures, and administrative issuances.
  • handles independently a wide range of multi-disciplinary, highly complex, and often sensitive and/or conflicting legal matters;
  • provides advice under different legal regimes, including public international law, private international law, international administrative law, EU law, and national laws, notably the law of the host state;
  • contributes to the expansion of the legal framework of the Centre, including the drafting of new or the review of existing legal instruments, policies, guidelines, or systems.
  • provides guidance and legal advice on general questions of public international law, including on issues of treaty law and practice under the Founding Treaty of the Centre as well as the privileges and immunities of the Centre and its staff under the Headquarters Agreement with the Portuguese Republic.
  • drafts or reviews legal instruments entered into by the Centre, including partnership agreements, procurement contracts, or consultancy agreements;
  • defends the Centre in arbitration or litigation proceedings arising from disputes with contractors or staff members;
  • manages the provision of the external legal services and serves as the certifying officer for the legal budget;
  • Provides guidance and legal advice in relation to lease contracts entered into by the Centre or its internationally-recruited staff members;
  • provides guidance and legal advice in relation to the protection of personal data; contributes to the design of new applications of, legal instruments, policies, guidelines, or systems in relation to data protection;
  • follows major activities in the field of international law or international administrative law as well as the national jurisprudence of the Centre’s host country with a direct impact on assigned tasks.
  • provides in-house training on legal matters;
  • supervises a Legal Officer as well as legal interns and consultants;
  • performs any other duties as required.

QUALIFICATIONS AND EXPERIENCE

  • An advanced university degree (Master’s degree or equivalent), ideally with a specialization either in public international law, international administrative law, supranational law or related fields;
  • A university degree in Portuguese law or professional experience with Portuguese law will be considered an asset;
  • At least 15 years of progressively responsible professional experience as a lawyer or legal expert, specializing in public international law, international administrative law, supranational law or related fields, whereby
    • at least five (5) years must have been gained at a senior level; and
    • at least five (5) years must have been gained as a lawyer or legal expert in an intergovernmental organisation;

Working experience in the United Nations or in a similar, globally operating intergovernmental organizations will be considered an asset.

  • Professional experience in legal analysis, research, and drafting;
  • Professional experience with employment-related issues, including staff disputes and related litigation;
  • Professional experience with partnership agreements, contribution agreements, co-funding agreements, or grants;
  • Professional experience in providing legal advice on public international law, notably on governance issues arising from international treaties or issues of privileges and immunities arising from headquarters agreements;
  • Professional experience in providing legal advice in relation to procurements;
  • Professional experience in providing legal advice in relation to intellectual property rights, notably copyright and the registration of trademarks;
  • Professional experience in providing legal advice to senior officials and/or governments at the national or international level; please explain how you meet this criterion using examples;
  • Professional experience in reviewing, drafting, and negotiating agreements and other legal instruments with intergovernmental organisations and/or governments will be considered an asset; please explain how you meet this criterion using examples.
  • Professional experience as a coordinator, team leader, and/or supervisor as required.
  • Resilience and experience in managing a significant workload and maintaining calmness under pressure.
  • Commitment to sharing information and contributing to the Centre’s learning and development strategy.
  • Knowledge and professional experience with results-based management (RBM) will be considered an asset;
  • Proven IT and presentation skills, including using Office 365; professional experience with ERP systems will be considered an asset;
  • Highest standards and personal attributes: strong professional and personal ethics; systematic support to human rights, respect for diversity, gender and youth mainstreaming;
  • Strong interpersonal communication skills based on respect for diversity including gender, youth, disability, and social/religious diversity;

LANGUAGES

Proficiency in English (written and spoken); proficiency (written and spoken) in another UN language, particularly Arabic, and/or proficiency (written and spoken) in Portuguese will be considered an asset;

TERMS OF APPOINTMENT

KAICIID offers fixed-term contracts of one year with a possibility of extension, depending on the continued need for the position.

Appointments are normally made at Step 1. The monthly net salary for Grade 3 Step 1 is EUR 7967. If eligible, housing and education allowance may also be provided.

KAICIID salaries are exempt from taxation in Portugal.
