Background

UN Women, the UN Entity for Gender Equality and the Empowerment of Women has been created to accelerate up the process of meeting the needs of women and girls across the world. UN Women supports UN Member States as they set global standards for achieving gender equality and works with governments and civil society to design laws, policies, programmes and services needed to ensure that the standards are effectively implemented and truly benefit women and girls worldwide. It works globally to make the vision of the Sustainable Development Goals a reality for women and girls and stands behind women’s equal participation in all aspects of life.

The project “Gender-Based Violence Response and Prevention Project in Tajikistan” implemented by UN Women with funding support of United States Department of State’s Bureau of International Narcotics and Law Enforcement Affairs (INL) is aimed to contribute to the protection of women’s rights, prevention and response to domestic/gender-based violence by development of targeted information, implementation of practical empowerment actions, education activities and awareness raising (“From Awareness to Zero Victims Blaming”) to increase reporting of violence cases though improved understanding of different forms of VAW, by stopping blaming the victims; and ultimately promoting gender equality. Equally important, the project will build more effective protection at district level by making the localized protection mechanisms functional, as well as by strengthening the potential of service providers, civil society women’s rights organizations and shelters, including technical support of shelters to better meet the needs of their clients - violence survivors.

The project is in line with the strategic priorities of the Government of Tajikistan, including its national development priorities, international commitments made in response to the CEDAW concluding observations (2018), and the Universal Periodic Review (UPR) in 2016.

In the part “Access to Justice” of the concluding observations of UN CEDAW Committee, made in October 2018 to Tajikistan, The Committee recommends that the State party:

                (a)          Ensure that all women and girls have access to an effective, confidential and gender-sensitive complaint mechanism and encourage reporting in cases relating to all forms of gender-based violence and discrimination.

                (b)          Promote and ensure the accessibility of free, gender-sensitive legal aid for women with insufficient means, including women belonging to disadvantaged groups, throughout the State party, and ensure that the right of victims to legal assistance, including of their own choosing, are guaranteed throughout the proceedings.

 

In the current scope of this assignment, the project intends to contribute to development of efficient models of prevention and protection from domestic violence in target districts by localizing the existing case management mechanisms; by training the members of the referral mechanism on key tasks and roles of its members in victim-centered services and support.

The GBV Prevention and Response Project aims to effect change by the reconfirming of the pathways for cooperation and strengthening of capacities of all actors that represent local referent mechanisms on rendering improved services to women and girls in line with international human rights standards. By actors the given TOR implies:

  1. Victim support centers, run by NGOs (incl. crisis centers, shelters, partial services)
  2. Victim support centers, run by the state bodies (such as victim support rooms under the health facilities)
  3. Child protection bodies (members of the Commission on the protection of the rights of a child)
  4. Health services
  5. Social services
  6. Legal services
  7. Law enforcement bodies (including the police)
  8. Judiciary organs (courts) (identify role of the courts if appropriate)
  9. Bodies of the Committee on women and family affairs under the GRT
  10. Independent Commissions and Oversight Bodies – Ombudsman’s Office, Ombudsman for Child Rights
  11. Public initiative bodies (including community/mahalla leaders, imams, others)

In case of absence of a concrete referral mechanism chain/member, consultant may suggest a replacement.

Goal and objectives of the consultancy:

The objective of this assignment is to meet and address recommendations of the CEDAW Committee and considering the need to offer to a beneficiary various support and service options and integrate existing services to  act in a coordinated approach, UN Women will hire GBV/EVAW National Consultant for designing the referral and cooperation scheme of the main actors in 3 target districts (Istaravshan, Varzob, Shahritus and partially Dushanbe) of the GBV Prevention and Response project design integrated response mechanism, which includes key State and non-State partners, as well as catalyzing strengthening of the NGOs’ and Crisis Centers’ coordination and collaboration.

Duties and Responsibilities

Under the supervision of the UN Women National Portfolio Coordinator, the consultant will perform the following tasks, that include but are not limited to the following:

  1. Identify existing State and non-State service providers and district level pathways for prevention and response to GBV/EVAW, including in the context of COVID-19 in three targeted districts (Istaravshan, Varzob and Shahritus) and partially Dushanbe.
  2. Assess and suggest (if relevant) other key stakeholders to address GBV in pilot districts, especially in the context of COVID and outline the scheme of logically linked actors of the GBV/EVAW referral mechanism at the target districts level – Istaravshan, Shahritus, Varzob and Dushanbe, when it is deemed that national level is required.
  3. Suggest coordinated internal response actions of the elements of referral mechanism to support women and girls – GBV survivors or those at-risk, with special attention to actions to be undertaken for protection of the rights of women and girls.
  4. Provide description of the concrete internal and external response actions for each actor that will guide primary duty bearers and service providers on how to respond to GBV cases and to guide the victims/ survivors of GBV, on where to seek assistance and what services are available at different referral points, including in the context of COVID-19 (like alternative communication ways and prevention steps on coronavirus spreading);
  5. Conduct trainings on the developed product, mobilize all actors/participants and strengthen their capacity to use the referral mechanism in 3 targeted districts, including Dushanbe. Conduct per 1 day training in 3 target districts (Istaravshan, Shahritus and Varzob) and 2 days training in Dushanbe.
  6. Present the results to UN Women and their key partners (possibly, during zoom or skype meeting).

In prescribing variety of action steps, the consultant must consider different groups of beneficiaries (a woman, a girl, a woman living with HIV, a woman-invalid, including different types of disability); presence or absence of necessary chains of the referral mechanism in concrete districts – Istaravshan, Shahritus, Varzob and Dushanbe, when it is deemed that national level is required; and ability to manage confidentiality and observe survivor-centered approach.

Qualifications:

Education:

  • A minimum of 3 years of experience in the area of gender-based violence (GBV), EVAW and related themes
  • Knowledge of the UN CEDAW Convention
  • Working knowledge of business processes of state structures and services on their operational ability to respond to GBV, f. ex. system-wide principles to respond to incidents, protect victims, and investigate and refer cases.
  • Prior experience in the work environment of an international agency, NGOs, UN, or international institutions.

Knowledge of languages:

  • Proficient knowledge of Tajik and Russian languages, English language is an asset

  • Financial Proposal:  Specify a total lump sum amount for the tasks specified in this Terms of Reference. The financial proposal shall include a breakdown of this lump sum amount per deliverable. Travel expenses to be included (two times travels to three pilot districts: Istaravshan, Shahritus and Varzob. One travel for meeting with partners to Identify existing State and non-State service providers and second travel for trainings, considering 2 overnights in 3 districts).  No extra payments will be made. 

Payment Schedule

Payment for the services provided will be made by deliverables as per the below table upon achievement of expected results and approval of the deliverable and acceptance of services by the UN Women (PERF) that the services have been satisfactorily performed.  

  1. First payment upon submission and approval of the the 1st, 2nd & 3rd deliverables.
  2. Final payment upon submission and approval of the 4th & 5th deliverables
