Purpose for the Post
The International Maritime Organization (IMO) is a specialized agency of the United Nations and frequently engages Consultants to support key aspects of its work. Under the overall supervision of the Director of Technical Cooperation and Implementation Division, the consultant will provide expertise on a project designed to strengthen Ukraine’s legal framework through a thorough legislative gap analysis and the development of actionable legal and regulation instruments aligned with the International Convention on Oil Pollution Preparedness, Response and Co-operation (OPRC Convention), the Protocol on Preparedness, Response and Co-operation to pollution Incidents by Hazardous and Noxious Substances, 2000 (OPRC-HNS Protocol) and other key conventions.
Main Duties and Responsibilities
1. Attend the Project’s inception workshop in Ukraine.
2. Conduct legal gap analysis to assess Ukraine’s existing legislative framework, institutional capacity, and resource allocation pertaining to marine pollution preparedness and response.
3. Identify and record the ratification process, including the legislative steps, which Ukraine has to follow in order to become a party to IMO instruments, including the stakeholders involved.
4. Further to the feasibility study undertaken by IMO to support Ukraine’s accession to the OPRC Convention and OPRC-HNS Protocol and other key conventions, review and support Ukraine in the implementation of the recommendations contained within the study.
5. Carry out and facilitate a workshop, deliver lectures and exercises to provide in-depth understanding on marine pollution preparedness and response convention related as well as legal support for the drafting of national legislation and regulations.
6. Provide advice on the development of maritime legislation and regulation relating to marine pollution to meet current and emerging needs.
7. Provide legal support for the drafting of national legislation and regulation transposing the provisions of the OPRC Convention and OPRC-HNS Protocol into domestic law and delineating institutional responsibilities and capacities.
8. Identify self-sustainable arrangements for the Government of Ukraine to have a system in place to be able, in future, to update its national marine pollution preparedness and response legislation and regulation on the basis on the new and/or amended instruments.
9. Prepare a detailed work plan with milestones for the review and updating of Ukraine’s national marine pollution preparedness and response legislation. including the drafting of amendments to current legislation, new legislation and relevant subsidiary legislation and regulation.
10. Organise and attend necessary further in person or virtual meetings with the national authorities to provide feedback, advice and guidance as appropriate on the drafting of implementing legislation and regulation to meet current and future obligations and respond to the questions of the national drafters.
11. Report regularly on developments, progress and challenges to project staff.

Required Competencies
1. Strong knowledge and understanding of international maritime law, especially IMO conventions including the OPRC Convention, the OPRC-HNS Protocol and related conventions as well as their method of implementation.
2. Experience with maritime environmental protection, particularly oil pollution preparedness and response frameworks.
3. Proven ability to assess legal and institutional frameworks.
4. Excellent legal drafting and advisory skills.
5. Demonstrated experience working with national governments and international organizations.
6. Thoroughness and good attention to detail in all responsibilities, ensuring accuracy in delivery and implementation.
7. Ability to coordinate activities and resources.

Professional Experience
A minimum of 10 years progressive working experience in legal consulting, regulatory reform, or legislative drafting, is essential. Previous involvement in projects related to environmental protection or marine pollution preparedness would be an asset. Experience with capacity-building and legal advisory in developing countries is desirable.
Education
An advanced university degree (master’s or equivalent) in maritime law, environmental law, international law, or a closely related field, is essential. Additional training in emergency response planning or maritime policy would be an asset.
Language Skills
Proficiency in English, both written and oral, is essential. Working knowledge of Ukrainian or one of the UN languages would be an asset.
Other Skills
Competent in the use of relevant IT applications including advanced skills in MS Office is essential.
