Project Context and Scope

Ukraine’s strategic objective of European Union membership has significantly intensified the need to harmonize national legislation, administrative practices and institutional frameworks with the EU acquis, particularly in the fields of migration governance, integrated border management, return policy, legal status of foreigners and stateless persons, residence and work permits, data governance, and inter-agency cooperation.

Following the granting of EU candidate status and the continued implementation of Ukraine’s EU integration commitments, the Government of Ukraine has advanced an ambitious reform agenda aimed at legal approximation, institutional modernization and the adoption of European standards in migration and border governance.

In support of this process, IOM Ukraine is implementing the EU-funded project “EU Support to Strengthening IBM in Ukraine (EU for Solidarity Lanes and IBM)”, which seeks, among other key initiatives, to enhance national capacities for EU-aligned migration policy development and border governance. Within this framework, Component 2.2 “Migration Policy Development and EU Alignment Support” provides legal, policy and technical assistance to key state stakeholders, including the State Migration Service of Ukraine, the Ministry of Internal Affairs of Ukraine, the State Border Guard Service of Ukraine, the Ministry of Foreign Affairs of Ukraine and other relevant authorities.

During the previous period of implementation, substantial progress was achieved in supporting legal approximation in the area of migration acquis, including legal analysis and drafting support related to the legal status of foreigners and stateless persons, the Single Permit framework, EU Blue Card, family reunification, long-term residence, and mobility of researchers, students, trainees and volunteers.

As part of the broader EU alignment process , Ukraine has initiated   the development of a coordinated national Schengen governance system. In line with the recommendations of the European Commission, Ukraine is developing a national Schengen strategy and an action plan.  Ukraine is expected to conduct screening of the Schengen acquis, identify legislation that is to be adopted or amended to be in line with the Schengen acquis, establish a systematic planning framework across relevant sectors, and develop the institutional architecture necessary for further alignment with Schengen requirements.

The Consultant will serve as the Chief Legal Expert responsible for delivering high-level legal expertise, contributing to legislative and policy development, supporting Ukraine’s EU and Schengen approximation agenda. It includes leading migration-related EU alignment efforts, advising state authorities on implementing the Rule of Law Roadmap and the National Programme on Adaptation, and contributing to the review and preparation of legal drafts. The work also covers screening Ukrainian legislation against the Schengen acquis, preparing recommendations on legislative amendments or new legal acts, interpreting relevant Schengen provisions on border management, border checks, visa policy, and information exchange, and advising on institutional and legislative measures required for alignment with Schengen standards.

Responsibilities

Tasks to be performed under this contract:
  • Lead comprehensive legal assessments of Ukrainian legislation on migration and border management, identifying gaps, inconsistencies, and compliance risks in relation to the EU acquis and international legal instruments.

  • Provide senior-level legal advice, expert opinions and strategic guidance to support government-led initiatives in the sphere of EU alignment, Schengen approximation, migration policy development and integrated border management reform.

  • Draft, review and support the development of legislative, regulatory and policy acts necessary for alignment with EU legal acts and European standards, Schengen acquis, ensuring legal accuracy, consistency, institutional feasibility and compliance with Ukrainian legislative technique.

  • Provide follow-up legal advice and technical support, as needed, on the implementation and further development of legislative initiatives related, but not limited to:

    - The legal status of foreigners and stateless persons in Ukraine, aligning national legislation with Directives 2011/98/EC, 2024/1233, 2014/36/EU, and 2014/66/EU, including the unification of procedures for residence and work permits under a Single Permit;

    - EU Blue Card scheme in accordance with Directive (EU) 2021/1883, including legal, institutional, and procedural adjustments;

    - family reunification and long-term residence in Ukraine, ensuring compliance with Directives 2003/86/EC and 2003/109/EC, and facilitate the introduction of independent residence permits and related provisions;

    - mobility of third-country national researchers, students, trainees, and volunteers under Directive (EU) 2016/801 etc.;

    - other migration-related areas of the EU acquis relevant to Ukraine’s EU integration process.

  • Provide high-quality, evidence-based analysis, policy and legal recommendations, and expert inputs to support informed institutional decision-making within Ukraine’s national Schengen governance process. This includes screening Ukrainian legislation against the Schengen acquis, conducting gap assessments, identifying legal and institutional requirements, preparing recommendations for further approximation, and supporting, within the project mandate, the work of the Interagency Working Group on Schengen governance and relevant sectoral working groups through legal analysis, expert inputs, review of draft documents, and participation in expert-level discussions.

  • Provide legal opinion, and support with legislative drafting if needed, on the functioning of the ICT solutions, being developed or modernized under the project, with particular attention to personal data protection, use of biometric data, information governance and consistency with the existing Ukrainian legislation and EU requirements.

  • Provide inputs and recommendations to the key policy documents in the area of migration and border governance of Ukraine;

  • Ensure strategic and operational coherence in the legal approximation process by proactively monitoring legal developments, assessing potential implications, and advising beneficiaries on required legal reforms.

  • Lead expert-level legal discussions with stakeholders such as SMS, SBGS, MIA, MFA, and others to ensure consistent application of EU-aligned legal principles and frameworks.

  • Produce policy briefs, legal opinions, and technical papers addressing complex legal matters related to inter-agency cooperation, including data exchange, institutional mandates, and ICT governance in migration management.

  • Participate in expert consultations, coordination platforms, and legislative drafting sessions, ensuring the project’s legal position is effectively articulated and integrated into national reform processes.

  • Support knowledge transfer and capacity development by preparing legal explanations, analytical notes and practical recommendations for national counterparts on selected areas of EU acquis, Schengen acquis and their relevance for Ukrainian legislation and institutional practice.

  • Perform other senior-level legal tasks related to EU integration, Schengen approximation, enhancement of migration and border governance legislation, and implementation of project activities as assigned by project leadership and/or requested by project beneficiaries.

  • Perform such other duties as may be assigned.

    Performance indicators for the evaluation of results:

  • Legal assessments, gap analyses, screening reports and expert opinions are comprehensive, legally accurate, evidence-based and clearly identify inconsistencies, compliance risks and required measures for alignment with the EU acquis, Schengen acquis, international legal instruments and Ukrainian legislation. Legal opinions, analytical notes, policy briefs, draft legislation, recommendations and other assigned outputs are submitted within the agreed deadlines and in accordance with the established workplan and priorities of the project beneficiaries.

  • Draft legislative, regulatory and policy documents are legally sound, internally consistent, compliant with Ukrainian legislative drafting requirements and appropriately reflect relevant EU legal acts, European standards and institutional arrangements.

  • Legal and policy recommendations are specific, actionable and adapted to the Ukrainian legal, institutional and operational context, providing clear options and practical steps for implementation.

  • The Consultant provides substantive and technically accurate inputs to the screening and approximation of Ukrainian legislation with the EU and Schengen acquis, including the identification of legal and institutional gaps, priorities, dependencies and recommended follow-up actions.

  • High-quality and timely legal support is provided in relation to priority migration and border governance reforms, including the Single Permit, EU Blue Card, family reunification, long-term residence, mobility of researchers and students, and other relevant areas of the EU acquis.

  • Legal opinions and recommendations related to ICT systems appropriately address personal data protection, biometric data processing, information exchange, institutional mandates and compliance with applicable Ukrainian and EU legal requirements.

  • The Consultant effectively facilitates and contributes to expert-level discussions with relevant state authorities and other stakeholders, clearly articulates legal positions and supports the development of coordinated and consistent approaches.

  • Legal analysis and recommendations effectively address matters related to institutional competencies, inter-agency coordination, data exchange and operational cooperation in migration and border management.

  • The Consultant provides substantive, well-prepared and constructive contributions during meetings, consultations, working groups, coordination platforms and legislative drafting sessions.

Qualifications

Education, Experience and/or skills required

  • Advanced Degree in Law, International Law, Migration Law or other related fields with at least fifteen years of experience.

  • Proven experience in the legal drafting of migration-related legal acts.

  • Extensive experience in policy and legislative analysis, including assessment of national legislation against EU law, international standards and institutional reform requirements.

  • Demonstrated experience in providing high-level legal advice to government institutions, international organizations, or public authorities involved in migration, border management, EU integration or related governance reforms.

  • Strong knowledge of Ukrainian legislation in the fields of migration, legal status of foreigners and stateless persons, border management, administrative procedure, inter-agency cooperation and data governance.

  • Knowledge of EU migration acquis, Schengen acquis and EU institutional requirements would be a strong advantage.

  • Experience in drafting or reviewing legal acts supporting ICT solutions, digitalization, information exchange, personal data processing or biometric data governance would be an asset.

  • Strong analytical, research and drafting skills, with the ability to translate complex legal and institutional issues into practical recommendations.

  • Excellent communication and coordination skills, including ability to engage with senior officials, technical experts and inter-agency coordination platforms.

  • Work experience in government institutions, research organizations, international organizations, or migration and border governance authorities.

  • Fluency in Ukrainian, knowledge of English would be an advantage.

IOM covers Consultants against occupational accidents and illnesses under the Compensation Plan (CP), free of charge, for the duration of the consultancy.
