International Expert to deliver a "Training on assessment of holding cells and rights of arrested persons for the Police Inspectorate of Kosovo PIK” (SSA)

Background:

In line with its mandate, the OSCE Mission in Kosovo (the Mission) has been supporting and building the capacities of the Kosovo institutions and civil society for effective protection of human rights and prevention of human rights violations since 1999. Through the years, the Mission has provided its support through capacity building trainings for the KP as well as the NGOs. In addition, in 2011, the Mission’s advocacy efforts resulted in the signing of a co-operation agreement on detention monitoring between the Kosovo Ombudsperson Institution and two local non-governmental organizations (NGOs), the Kosovo Rehabilitation Centre for Torture Victims (KRCT) and the Council for the Defense of Human Rights and Freedoms (CDHRF). 

According to Kosovo legal framework, Police Inspectorate of Kosovo (PIK) is entitled to conduct inspections of Kosovo Police (KP). Implementation of PIK’s oversight function allows to monitor effectively police performance in different areas, including interaction with arrested persons. According to the paragraph 2, article 26 of Law on Police Inspectorate of Kosovo (PIK) , “PIK conduct for inspection includes but is not limited to the following actions:  
2.1. Checking the condition of buildings, vehicles and equipment; 
2.2. Checking the records and files, including either hard copy of the documents, electronic, or audio or video records; 
2.3. Interviewing employees and members of the public; 
2.4. Interviewing escorted and arrested persons”.

PIK conducts regular inspection of KP in different areas of their work. Recently the PIK requested Mission support to conduct a training on procedures related to assessment of holding 
cells  and rights of arrested persons. During the needs assessment process, the PIK leadership emphasized that the training should focus on:
-    monitoring police compliance with human rights standards when arresting or escorting residents to the police station, 
-    assessment of conditions provided to arrested/escorted persons at the police stations

Enhancing knowledge of PIK staff on this matter is an important part of upholding the institution’s capacity to monitor compliance of police with human rights standards and internal procedures. Such a training is of utmost importance, in light of the fact that a system of monitoring the procedures and places where persons are deprived of their liberty is a key element in assessing the compliance of Kosovo institutions with international human rights standards and domestic law. 

Depending on the situation with the pandemic, as an alternative plan, the activity will be organized through an online modality.
 

Objective of Assignment:

The objective of this training is to enhance the knowledge and skills of PIK staff to monitor police compliance with human rights standards while interacting with residents when arresting or escorting them to KP stations, and to assess existing conditions in police stations for arrested and escorted persons.  
 

 

Duration of Assignment:

The consultant will be contracted for a total of four (4) working days

 

Tasks and Responsibilities:

Under the supervision of PDMS, the international consultant shall: 

•    Develop the training methodology and materials; 
•    Deliver a two-day training on assessment of holding cells and rights of arrested persons;
•    Produce post-training evaluation report and recommendations for further action. 

Deliverables:

•    By 10 September 2021, prepare and submit to the project manager the training agenda, presentations, exercises and case studies for the training in electronic form;
•    On 21 and 22 September 2021 to deliver a two-day of training for PIK officers. The training will last from 10 AM until 4 PM;
•    By the end of September 2021, submit to the project manager a post-training evaluation report of the participants and the training in general and recommendations for further action.

 


Performance Indicators:

•    Training agenda and all material delivered on time in an appropriate format as requested by the project manager. The trainer and the project manager will agree on the appropriate form during the initial phase of the assignment;
•    Training delivered as planned;
•    The feedback provided by the participants. The post-training evaluation report submitted on time.
 

Necessary Qualifications:

•    University degree in law, political sciences, international relations or other field;
•    At least twelve years of training and/or lecturing experience on the issues of prevention of torture;
•    At least twelve years of monitoring human rights issues related to prevention of torture at international level;
•    Excellent understanding of international human rights standards;
•    Excellent facilitation and presentation skills;
•    Professional fluency in English.

 

Remuneration Package:
Remuneration will depend on the qualifi cations and experience of individual expertsas well as the detailed work plan to be agreed upon and will be based on the current OSCE consultancy rates.
