ORGANIZATIONAL CONTEXT

The International Development Law Organization (IDLO) enables governments, empowers people, and strengthens institutions to realize justice and promote peace and sustainable development. IDLO is the only global intergovernmental organization exclusively devoted to promoting the rule of law and access to justice.

With its Headquarters in Rome, Italy, a Branch Office in The Hague, and Permanent Observer Missions to the United Nations in New York and Geneva, IDLO carries out policy advocacy, research and learning, as well as rule of law and justice programmes in countries through some 17 Country Offices operating in every region of the world.   

The IDLO, in collaboration with other consortium members, is promoting a reformed and modernized Alternative Dispute Resolution (ADR) system through the establishment and operationalization of a new ADR Centre in Somaliland under the Program 'Strengthening the social contracts through access to justice" funded by the Government of the Netherlands (Also known as Damal Programme). The programme aims to foster the social contract in Somaliland by increasing the legitimacy of justice institutions. 

The overall goal of the programme is expected to be achieved through three (3) intermediate outcomes: (1) improved access to an Alternative Dispute Resolution(ADR) mechanism and referral pathways, especially for vulnerable groups; (2) enhanced access to formal justice for vulnerable groups through holistic support to gender-based violence (GBV) survivors and affected communities; and (3) increased participation of citizens in Somaliland in accountability processes relating to the provision of security and justice. The specific mandate of each Centre is to facilitate the practice of ADR and settle claims and disputes at the community level, facilitating and increasing access to justice for the local population, particularly vulnerable categories.

THE ASSIGNMENT

IDLO seeks a short-term Justice Assistance Advisor to support IDLO and its implementing partners. To further complement the work of the ADR Centre’s the program will operate along the lines of an Implementation Centre (IC) which will be made up of IDLO programme staff, local partners program officers, paralegals, and lawyers. The Justice Assistance Advisor will work to review and implement a case management system (CMS), develop a service provision map and deliver training to justice actors on the operationalization of the CMS, Implementing Partners (IPs), and Implementation Centre (IC) members. The position will provide technical support, guidance, and consulting services to the IDLO programme team and local implementing partners within the framework of capacity building. 

Period of Consultancy:

The consultant will be based in Somaliland and is expected to work for 30 days.

The Specific objective of the consultancy:

Under the direct supervision of the Field program manager, the advisor will collaborate with other Damal programme staff and implementing partners based in Somaliland. The advisor shall:

  • Conduct an in-depth review and analysis of services available and develop service provision maps with formal justice institutions, health services, LAOs, and ADR Centers in each implementing area identifying the services available, contact details, and location of service. 
  • Provide support to the IC members on how to successfully implement the service delivery maps. 
  • Assist the programme to review the case management 
  • Preliminary analysis of the case workflow within the ADR offices.
  • Create a system design document for the Case Management System
  • Implementation of the Case Management System and 
  • Conduct quick training need assessment and deliver six capacity-building training on legal knowledge and case management to self-help groups. 
  • Monitoring and support for two weeks after completion of work.
  • Provide technical advice to IDLO and implementing partners during the delivery period as well as attend meetings or relevant conferences related to the area of consultancy if requested. 

Scope of financial Proposal and Schedule of Payments

  1. The Advisor will be offered a lump sum fee inclusive of travel costs, accommodation and subsistence allowance during work assignments (where applicable)
  2. The payments will be made in installments based upon outputs/deliverables specified in the TOR (under a payment schedule) and upon certification of satisfactory work as per the work plan endorsed by Damal.

Payment Schedule 

  1. 20% on signing the contract and submission of an inception report including methodology and work plan for the deliverables listed below. 
  2. 40% on completion, submission, and confirmation by the supervisor of deliverables 2 to 5. 
  3. 40% on submissions of deliverables 6 to 9 and confirmation from the supervisor 

List Deliverables

The Justice Assistance advisor is expected to perform all the following deliverables: 

  • Three pages Inception report detailing the proposed methodology and agreed work plan submitted within 5 days from the date of signing the Contract.
  • A one-to-one meeting with local partners to understand their Year 2 work plan with a focus on justice assistance and case management.
  • Conduct a capacity needs assessment on potential IC members on prevention and response to users/victims' justice needs.
  • In-depth review and analysis of the services available in the implementation areas followed by the development of service provision maps for formal justice institutions, health services, LAOs, and ADR Centres in each implementing area in collaboration with programme partners.
  • Provide targeted training to all ORC members. The training needs will be informed by the needs assessment conducted.
  • Training deliverables - four-day training on case management for justice actors, in collaboration with Damal programme partner:
  1. Detailed training plan (including objectives, methodology to be adopted, training modules, and schedule), to be sent in Microsoft Word format via electronic submission to the PM within five days after the signature of the agreement. The training plan should be a minimum of 5 pages.
  2. PowerPoint presentations, as well as training, approaches for participants (i.e., case studies, group work, brainstorming, discussions, etc.), to be sent via electronic submission to the PM for review and input.
  3. Pre-/post-test evaluation form to be utilized for each training session as well as completed pre-/post-test evaluation sheets. Completed forms to be sent via electronic submission to the PM.
  • Training deliverable - six capacity building training on legal knowledge and case management for self-harm groups in collaboration with Damal programme partner:
  1. Detailed training plan (including objectives, methodology to be adopted, training modules, and schedule), to be sent in Microsoft Word format via electronic submission to the PM within five days after the signature of the agreement. The training plan should be a minimum of 5 pages.
  2. PowerPoint presentations, as well as training, approaches for participants (i.e., case studies, group work, brainstorming, discussions, etc.), to be sent via electronic submission to the PM for review and input.
  3. Pre-/post-test evaluation form to be utilized for each training session as well as completed pre-/post-test evaluation sheets. Completed forms to be sent via electronic submission to the PM.
  • Weekly updates on service provision maps and training (such as the composition of attendees, notable discussions, or reflections), are to be submitted to the PM every Monday morning. Reports will be a minimum of 2 pages and are to be submitted electronically in Microsoft Word format. A sample template will be provided.
  • Report on assignment including an analysis of consultancy achievements, pre/post evaluation results, challenges, lessons learned, and recommendations for the future. The report should be at least 20 pages in length and will be submitted electronically within 15 days of completion of activities to the PM in Microsoft Word format.

IDEAL CANDIDATE PROFILE 

Competencies 

To deliver these above-mentioned objectives and the associated scope of work, IDLO is searching for a candidate with the following skills and experience: 

  1. Excellent knowledge and understanding of the justice issues in the eastern region of Somaliland: IDLO and its partners operate in complex environments and deliver a diverse portfolio of projects. To deliver long-term outcomes (scale-up, replication, sustainability, etc.) and help the program develop a reputation for excellence (responsive, pioneering, professional, etc.) the successful candidate will need to demonstrate a deep conceptual understanding of the justice-related issues facing the communities in the eastern regions. 
  2. Extensive experience in case management training and capacity building. The Damal program is setting up a number of ADR centers and capacity development for local IPs. The successful candidate is expected to provide development training material, templates, manuals, etc for case management and capacity-building training for local partners and IC members. The successful candidate will need to demonstrate a proven track record of delivery, which will allow them to build on this work. 
  3. Excellent knowledge and experience of training, one on one monitoring, and coaching others in case management systems and the use of service provision maps. The successful candidate will need to demonstrate their potential to provide targeted support to Damal's local IPs and IC members to build in-house capacity and improve the coherence of the program activities. 

Education and Professional Experience

  • Seven years' work experience in access to justice, legal field, and other related fields
  • Proven experience in successfully training design and delivery on the use of information and case management systems.
  • Proven experience with case management, data entry, and complex data collection systems in a similar program context.
  • Seven years of international experience or working for international organizations on issues of case management 
  • Extensive knowledge of the legal and justice systems in Somaliland.
  • Advanced master’s degree and equivalent education in Law, International Human Rights, Public Policy, or any other related field

Language Skills

  • Fluent oral and writing in English.

Specific Technical Skills and competencies:

  • Excellent writing skills in English.
  • Excellent knowledge of the African traditional justice system and ability to interact with government officials, justice stakeholders, elders, scholars and sharia leaders.
  • Demonstrated experience in conducting training.
  • Ability to work under the pressure with tight deadlines and flexibility.
  • Highly organized with the ability to work under pressure.

Assessment Criteria

  1. Knowledge and understanding of ADR in Somaliland context and development of service provision maps – 25%
  2. Significant prior experience with case management systems, data entry, and complex data collection systems in similar program context – 40%
  3. Knowledge and understanding of the main justice issues facing SGBV survivors, IDPs, and other vulnerable groups in Somaliland – 20%
  4. Knowledge and experience on developing training material and providing training and capacity building sessions – 15%
