PROJECT BACKGROUND

About GGGI

GGGI has been the trusted advisor to the Government of Colombia (GoC) for more than half a decade on the planning, structuring, and transitioning to an environmentally sustainable and socially inclusive economy. During this period, GGGI has provided advisory services to national public entities, including the Ministry of Mines and Energy, the Ministry of Environment and Sustainable Development, the Ministry of Agriculture and Rural Development, and the National Planning Department.

GGGI, with support from the UK Partnership for Accelerating Climate Transition (UKPACT), is providing advisory services to the Ministry of Mines and Energy (MinEnergía) and the Institute for the Planning and Promotion of Off-grid Electrification (IPSE) to advance in Colombia's energy transition and rural electrification efforts.

Under the framework of this collaboration, GGGI will support MinEnergía enhancing the current regulatory framework in energy transition according to the objectives and policies of the Government of Colombia.

 

OBJECTIVES OF THE ASSIGNMENT 

The main objective of the consultancy is to support the Ministry of Mines and Energy of Colombia in designing and establishing the energy communities' strategy.  

The Consultant will principally support the office of the minister, in coordination with the Environment and Social Affairs Division, Electric Energy Division, Office of Regulatory and Business Affairs, and other relevant divisions of MinEnergía in specific tasks related to the design and establishment of the energy communities in Colombia, as follows:

  • Carry out a regulatory and legal barriers assessment of energy communities in Colombia involving a comprehensive view in terms of the possible contributions to the SDG, territorial ordering, possible environmental restrictions, and economic opportunities, among others.
  • Support the GGGI GESI expert and Team in elaborating at least two (2) case studies from relevant countries showcasing the social and environmental benefits and challenges of Energy Community solutions.
  • Develop recommendations for integrating the "Energy Community" concept in current renewable energy policies, including gender equality and social inclusion approaches to energy communities.
 
DELIVERALBES AND PAYMENT SCHEDULE

The expected outputs/deliverables are:

1)      Consultancy workplan

The Consultant must prepare a detailed workplan outlining the timeline of main activities, methodology, milestones, validation meetings, partial and final deliverables. This deliverable should include feedback from MME's technical Team, focal points, and GGGI supervisor.

2)      Case studies from relevant countries showcasing benefits of Energy Community Solutions Report.

The Consultant must work with the GGGI GESI expert and Team to elaborate at least two (2) case studies from relevant countries showcasing the social and environmental benefits of Energy Community solutions. The report should include a comprehensive description of the cases in terms of organization scheme; regulatory framework; energy auto-consumption, selling and grid consumption; socio-economic implications regarding job creation, social and environmental risks and mitigation plans, entrepreneur projects created; and environmental aspects. The case studies should include recommendations for Colombia's energy communities' strategy.

3)      Regulatory and legal barriers assessment of energy communities in Colombia.

In close consultation with MinEnergía's Team, the Consultant shall report the regulatory and legal barriers to implementing the "energy communities" in Colombia. The Consultant must consider at least the following inputs:

  • The National Development Plan 2022-2026 approved by the Congress of Colombia, as well as the advances in the Just Energy transition Roadmap in development by MME and CONPES documents.
  • The results and findings from Deliverable 2.
  • At least five regional experiences in Colombia that can be understood as energy communities in terms of organization, resource invested and the correspondent source, socio-economic opportunities leveraged from the energy power supply, and regulatory conditions (Energy tariff scheme, subsidies, territorial ordering, etc).

The structure of the document will be defined according to the guidelines of MME.

4)      Recommendations for regulatory adjustments to implement energy communities in Colombia.

The Consultant will accompany and advise MinEnergía in defining a regulatory strategy with the list of regulation adjustments (e.g., laws, decrees, resolutions, agreements, or concepts) needed to implement  the energy communities. The Consultant will develop recommendations for integrating the "Energy Community" concept into current energy sector policies (i.e., Law 1715 of 2014 and Law 2099 of 2021)

The process of designing the energy communities strategy may include participating in workshops, meetings, and conferences, collecting feedback and comments from relevant stakeholders (public institutions, private companies, academy, and civil society), as well as supporting the preparation of concepts about the topics related with the scope of this consultancy required by MinEnergía.

With the proposal document, the Consultant shall deliver a complete follow-up report of the activities carried out in the consultancy and attach relevant evidence.

5)      Regulatory instrument draft

The Consultant will work closely with MinEnergía's technical and legal teams to develop one (1) regulatory instrument that integrates the "Energy Community" concept in current renewable energy policies (i.e, Law 1715 of 2014 and Law 2099 of 2021. For this deliverable, the Consultant must consider the following:

  • A detailed draft of the selected regulatory instrument (e.g., decree, resolution, law project, etc.) according to the instructions of MinEnergía. In this part of the process, the Consultant shall periodically present to MinEnergía and GGGI the advances in the draft document to be reviewed, and carry out the adjustments required, if pertinent.
  • Presentations, briefs, and notes required for the approval process of the instrument.
  • An "argumentative/justification memory document" accordingly to MinEnergía's forms and procedures for its adoption.
  • An annex that includes all the additional support required by Minenergía such as edits, modifications and  concepts needed to complete its legal adoption by the Government.

With the draft document, the Consultant shall deliver a complete follow-up report of the activities carried out in the consultancy and attach relevant evidence.

6)      Consultancy Final Report

The Consultant will present a Final Report summarizing the main deliverables and activities of the assignment, attaching the correspondent evidence such as minutes of meetings, responses to comments and feedback, presentations, concepts, and another kind of evidence of the support given to Minenergia related to the design and establishment of the Energy Communities in Colombia.  

 

REPORTING ARRANGEMENTS

The Consultant will work closely with the minister's office in coordination with the Environment and Social Affairs Division, Electric Energy Division, Office of Regulatory and Business Affairs, and other relevant divisions of MinEnergía.

The Consultant is expected to provide the necessary dedication time in the consultancy, according to the work's dynamics and the supervision requirements, including attendance in workshops, meetings, conferences, interactions with relevant stakeholders, and weekly reporting sessions with GGGI's supervisor.

During the follow-up meetings, the Consultant will be asked to report progress regarding the contractual objectives, activities, and milestones.

All deliverables must be approved by MME's and GGGI's supervisor. Deliverables 1 and 6 must be completed in Spanish and English, the rest should be completed in Spanish.

 

Suggested methodology and competence requirements.

The Consultant should follow the specific methods detailed in the workplan (deliverable 1) and follow Minenergía's and GGGI's instructions. The Consultant will best use both primary and secondary sources of information to develop activities defined under the contract objective.

The Consultant will prepare the required presentations, briefs and notes about the consultancy objectives, activities, and milestones

As a contractor of GGGI, the Consultant must promote the synergy and articulation between the relevant stakeholders and internal areas of MinEnergía. The Individual Consultant shall treat all information and documents that he/she receives in connection with the provision of the Services as confidential unless expressly stated otherwise.

Reporting Arrangements.

The consultant work progress will be monitored primarily through periodic review meetings for planning and biweekly short face-to-face (or virtual) meetings for prioritizing activities, all of that previous consensus with the Green Growth Implementation Officer and Project Manager who will act as the Contract Supervisor. In this review, meetings will tackle subjects such as the overview of the contractual objectives, the development of activities, detailed information milestones, actual achievements alongside the timeline initially set, and any other relevant progress details.

Deliverable 1 must be produced in English and Spanish, and the rest must be written in Spanish, in accordance with GGGI's formatting requirements, and submitted with proof of editable file back-up (e.g., .docx, .pptx) in the GGGI SharePoint system. Final products must be developed accordingly with standard templates that GGGI will provide to the Consultant. Where relevant, the Consultant shall also provide sets of raw data, research materials, and meeting notes related to the contractual objective.

Suggested methodology and competence requirements.

The Consultant should follow the specific methods provided by the Contract Supervisor. The Consultant will make the best use of both primary and secondary sources of information to develop activities defined under the contract objective.

The Consultant will be responsible for providing transparent financial information regarding expenses incurred for conducting field visits, orientation meetings, webinars, or workshops. It´s expected to carry out at least one national trip with Minenergía. The trip costs are already included in the estimated consultant fees; therefore, no extra travel costs will be covered by GGGI unless another trip will be required.

 

EXPERTISE REQUIRED

The Consultant should demonstrate the credentials described below:

  • University degree in Law, Public Administration, political sciences or related areas.
  • A postgraduate degree in relevant areas related to the scope of the contract. e.g.  Energy Sector regulations, Public services, Public Finances, Public Administration, or Government.
  • General professional experience: A minimum of five years of relevant work experience.
  • Specific professional experience: Proven track record working in the energy sector in Colombia is required.
  • Prior work experience with the Ministry of Mines and Energy or related entities is a plus;
  • Skill, and knowledge:
    • Native Spanish proficiency.
    • Proven experience in writing legal/policy instrument documents.
    • Proven experience in working or collaborating on projects in Energy Sector.
    • Demonstrated record in working autonomously and as part of a team.
