IOM is dedicated to promoting humane and orderly migration for the benefit of all. It does so by providing services and advice to governments and migrants. Context:

International consultant to develop international migration law programme for Justice Academy, Ministry of Justice to enhance the capacities of judges, candidate judges and prosecutors. Background Information:

IOM Azerbaijan is currently implementing a counter trafficking project that aims to assist the Government of Azerbaijan’s response in combating trafficking in persons and to improve protection mechanisms in providing vulnerable migrants as well as victims/potential victims of trafficking with appropriate assistance services.

The project specifically focuses on enhanced judicial capacity to provide better protection, assistance, and access to justice to migrants through the development and institutionalization of the International Migration Law (IML) Course Programme within the Justice Academy of the Ministry of Justice. Through a consultative process, IOM will develop a curriculum, handbook and training materials. Training of Trainers, four cascade trainings, and international workshop will be held to mainstream the training materials into the Justice Academy. IML Course Programme will cover the international and national legal norms in regulating migration, set of international rules and principles governing the movement of people between states and the legal status of migrants in host states. It will support the interpretation and application of legal provisions related to human rights and fundamental freedoms in line with European Law (European Union Law and Council of European Standards as well as related case law) and will include specific chapters on European and other relevant international instruments, adapted according to the European case law and cover other issues related to the judiciary system to showcase best practices. The framework of the curricula and training materials will be agreed by relevant stakeholders.

Core Functions / Responsibilities:

Task to be performed under contract:

• The consultant will work in close coordination with IOM IML unit and national stakeholders to develop the IML Course Programme for judges/candidate judges/prosecutors throughout the consultancy period. Series of meetings will be held with the government agencies during the development of the training materials.

Page 1 / 3• The consultant will liaise with the Justice Academy and relevant government agencies to develop curricula and training materials and will ensure that training materials are developed to address the needs of the judiciary on building their knowledge about the legal norms in international migration law

The consultant will develop i) curricula and training materials framework, ii) deliver training of trainers, and ii) provide technical support and participate in international workshop held in Azerbaijan. These will include training materials (texts, case studies, presentations, quizzes, check list, evaluation tools etc.) for the judges and prosecutors. The materials will be developed in-line with International/ national migration law, Council of Europe instruments, Azerbaijani cases studies within the criminal justice system.

Tangible and measurable output of the work assignment

• Develop International Migration Law Programme within the Justice Academy of the Ministry of Justice for continuous education of Judges, Candidate Judges and Prosecutors; • Liaise with the Justice Academy of the Ministry of Justice of Azerbaijan, State Migration Service, and other relevant stakeholders to ensure mainstreaming of the training materials; • Liaise with relevant partners to discuss and identify the needs and priorities of the judiciary in relation to the development of the training materials;

• Develop and finalize international migration law training materials for Justice Academy lecturers; and judges/prosecutors/candidate judges in-line with the international and European standards;

• Deliver Training of Trainers for the Justice Academy lecturers and judges/prosecutors/candidate judges in accordance with the IML curriculum in Baku and; • Provide technical support and participate in the international workshop on international migration law in Baku.

Required Qualifications and Experience:

Education

• Master's degree in law, international law or a related field from an accredited academic institution or a related field from an accredited academic institution with five years of relevant professional experience; or

• University degree in the above field with seven years of relevant professional experience in international law, human rights law and/or development issues.

Experience

• Practical legal experience, preferable in international law with focus on migration; • Experience in carrying out trainings and developing training materials for judges and prosecutors;

• Strong analytical and writing skills to develop training materials for judiciary based on international and European law;

• Ability and experience in liaising with government authorities as well as with international institutions

• Demonstrated ability to draw legislative provision and legal framework from relevant international, regional and national practices and processes and adapt them to the realities of Azerbaijan;

• Sound knowledge of international migration law issues and literature; • Previous experience on international migration law in the region is an added advantage. Languages

• Fluency in English is required. Working knowledge of Russian is an advantage. Page 2 / 3Desirable Competencies:
