Legal Consultant, Nutrition Section, Islamabad (For Pakistan Nationals Only)

The overall purpose of the assignment is to understand the gaps and limitations in the Protection of Breast-Feeding and Child Nutrition Ordinance, 2002 with regard to the International Code of Marketing of Breastmilk Substitutes, World Health Assembly (WHA) Recommendations A69/7 and other relevant international guidelines/legislation and to explore potential amendments required to national breastmilk substitute legislation to regulate marketing of all milk substitutes and food products for children under 36 months of age and violations of the international code of breastmilk substitute, recommendations and legislation. The said consultancy will also analyze the existing Drug Regulatory Authority of Pakistan (DRAP) rules 2014 with respect to the infant young child feeding related food products and will provide recommendations for amendment.

Purpose of the Assignment

The overall purpose of the assignment is to understand the gaps and limitations in the Protection of Breast-Feeding and Child Nutrition Ordinance, 2002 with regard to the International Code of Marketing of Breastmilk Substitutes (BMS), World Health Assembly (WHA) Recommendations A69/7 and other relevant international guidelines/legislation and to explore potential amendments required to national breastmilk substitute legislation to regulate marketing of all milk substitutes and food products for children under 36 months of age and violations of the international code of breastmilk substitute, recommendations and legislation. The said consultancy will also analyze the existing Drug Regulatory Authority of Pakistan (DRAP) rules 2014 with respect to the infant young child feeding related food products and will provide recommendations for amendment.

To make a difference, you will be accountable for the following tasks and deliverables:

1. To review and identify gaps/limitations of the current national legislations (Ordinance and Rules) on marketing of breastmilk substitutes in line with the International Code of Marketing of Breastmilk Substitutes, and WHA Recommendations A69/7.
2. To review and identify gaps/limitations of the current provincial legislations (Provincial Acts and rules) on marketing of breastmilk substitutes in line with the International Code of Marketing of Breastmilk Substitutes, and WHA Recommendations A69/7.
3. To explore potential amendments required to the Protection of Breast-Feeding and Child Nutrition Ordinance, 2002 and Rules 2009 through a consultative process with key federal and provincial stakeholders.
4. To provide a revised draft of the Protection of Breast-Feeding and Child Nutrition Ordinance, 2002 and Rules 2009 in line with the International Code of Marketing of Breastmilk Substitutes, and WHA Recommendations A69/7.
5. To obtain approval and endorsement of the revised Protection of Breast-Feeding and Child Nutrition Ordinance, 2002 and Rules 2009 from the Ministry of National Health Services, Regulations and Coordination (MoNHSR&C) and provinces.
6. To review and identify gaps and limitations of the current Rules of Alternative Medicines and Health Products, 2014 under the Drug Regulatory Authority of Pakistan.
7. To provide appropriate recommendations on baby food related clause in DRAP rules 2014, inline to the recent WHA, 2016 recommendations.

Expected Deliverable

1. Provide inception report, which includes detailed workplan with timelines.
2. Prepare literature review document of all existing Pakistan legislative documents on BMS (national and provincial) and drug regulatory authority/rules etc.
3. Coordinate with MoNHSR&C, provincial departments of health, Law and Justice Commission of Pakistan (situated at supreme court) and other relevant stakeholders on gap analysis in existing relevant legislative documents.
4. Prepare a gap analysis report with recommendations for federal and provinces, to be shared through a workshop.
5. Drafting first draft of revised federal legislative act and rules share with MoNHSR&C for review.
6. Provide expert support during consultative meetings with the key stakeholders to gather the information on legislative environment, its implementation, enforcement mechanism and monitoring & evaluation.
7. Revised draft prepared based on the comments and recommendations from MoNHSR&C and submitted for final approval.
8. Approved draft is ready to be tabled in Parliamentary task force.
9. Comments and questions from parliamentary task force are addressed and incorporated in the final version of national legislative documents (Ordinance/Act & Rules)
10. Final draft of national legislation (Ordinance and all Rules) submitted to MoNHSR&C, presentation of key findings and recommendations submitted.

Estimated Duration of Contract:

4 Months, starting June 2018

Anticipated Travel Itinerary             

The consultant will be required to travel locally within Pakistan.

Qualifications of Successful Candidate

Applicants are requested to submit a financial quotation indicating monthly fee.

Education

• Advanced university degree in Law

Experience

• Demonstrate able capacity and experience of at least 8-10 years.
• Experience working on health and nutrition related legal documents (acts/rules/litigation)
• Experience in writing laws/acts/rules 

Language Proficiency

• Written and spoken fluency in English

Technical Skills and Knowledge

• Strong analytical, oral & written communication skills
• Proven track record in working on the bills/acts related to health and nutrition safety
• Effective facilitator with proven ability to engage group of individuals
• Demonstrated ability to work in a multi-cultural environment
• Good understanding knowledge on health and food safety and security.
• Experience in writing legislative documents on health/nutrition/food as per global recommendations.
• Proficiency in the development of Bills/Acts /Rules and interpretation of legal documents.
• Familiarity with local context and appropriate knowledge of provincial and national level nutrition and food security policies and programs
