National Council on the Administration of Justice

The NCAJ is established under Section 34 of the Judicial Service Act (No.1 of 2011). The Council is a high-level policymaking, implementation and oversight coordinating mechanism as reflected in its membership that is composed of State and Non- State Actors from the Justice Sector. The main purpose of the Council is to ensure a coordinated, efficient, effective and consultative approach in the administration of justice and reform of the justice system.

One of the Taskforces housed under the NCAJ is the Special Taskforce on Children Matters was appointed by the Hon. Chief Justice vide Gazette Notice No. 369 of 29th January 2016 with a mandate to address gaps regarding the administration of justice with regard to children and is under the leadership of Lady Justice Martha Koome. The Task Force is mandated to deliver on sixteen areas that form the terms of reference. Collapse into three thematic areas these are: 1) legislative, policy, procedural and practice directions reforms, 2) survey and data compilation on all matters of children and training, and 3) infrastructure and co-ordination of all the actors. 

THE ASSIGNMENT

The special task force on children matters development various policy documents including the Diversion Toolkit for child practitioners; Standard Operating Procedures (SOPS) For Child Protection Units (CPUS); Policy on Continuous Professional Development (CPD) On Juvenile Justice; and the Court Practice Directions on Children Cases. The institution seeks for consultancy for legal drafting services of the four documents in a professional and impartial manner.

DELIVERABLES  

An Inception Report detailing the understanding of the terms of reference and a proposed methodology, plan of action, with a work plan indicating clear milestones and timelines. To be delivered within 10 days of contract start; 

  1. Draft Diversion Toolkit for child practitioners; Standard Operating Procedures (SOPS) for Child Protection Units (CPUS); Policy on Continuous Professional Development (CPD) On Juvenile Justice; and the Court Practice Directions on Children Cases by the 30th April 2020
  2. Conduct at least two validation meeting on the four documents for the month of April 2020.
  3. Incorporate relevant feedback received from the validation forums into the draft documents by the by the 10th May 2020;
  4. The final Diversion Toolkit for child practitioners; Standard Operating Procedures (SOPS) for Child Protection Units (CPUS); Policy on Continuous Professional Development (CPD) On Juvenile Justice; and the Court Practice Directions on Children Cases by the 20th May 2020. 

IDEAL CANDIDATE PROFILE

The selected Expert will possess the following qualifications and experience;

  1. Hold a Bachelor of Laws, Social Sciences Degree and post-graduate qualifications. Must have professional training in legislative drafting.
  2. At least 10 years’ experience within the field of legislative drafting and policy development and experience of drafting related to the justice sector will be an added advantage.
  3. Broad knowledge and understanding of the rule of law and general constitutional implementation in Kenya at policy and planning level and/or implementation level. Knowledge of evolvement of the Kenya judicial reform programme is a critical asset
  4. Possess strong work ethic characterized by desire to achieve results. Strong problem- solving skills, with a high degree of personal and professional organization.
  5. Ability to multi-task in a high-pressure environment, respond rapidly to ad hoc requests, meet tight deadlines and ensure diplomacy and tact when engaging with prominent public figures.
  6. Ability to work independently and flexibly to deliver the agreed outputs and respond to feedback in a timely and professional manner.
  7. Computer savvy, able to navigate necessary programs with proficiency.
  8. Possess excellent interpersonal and communication skills, including strong writing and presentation skills in the English language.
  9. High levels of integrity and ability to maintain confidentiality.

REMUNERATION 

Lump sum for performing all tasks, services and producing the deliverables, IDLO shall compensate the Contractor the amount of (One million two hundred thousand Kenya Shillings) (1,200,000 Ksh.) All fees are subject to KRA withholding tax.
