Nature of the Consultancy

Capacity building for diplomats on combating human trafficking through trainings and development of consular manual on counter trafficking

Background Information:

IOM under its Enhancement of National Capacities to Combating Human Trafficking in Azerbaijan (ENCT) project aims to strengthen the capacity of the Government of Azerbaijan in effectively countering human trafficking and protecting victims of human trafficking. Specifically, the project aims to enhance regional and international cooperation and partnerships to fight against human trafficking and protect trafficked persons. Skilled and trained personnel (including diplomats, administrative and technical/service staff) of diplomatic representations (i.e. embassies and consulates), in addition to law enforcement officers and customs officers either abroad or at home, play a major role in increasing identification, referral and protection of workers who could fall prey to exploitation and trafficking. It is, therefore, indispensable to raise awareness and capacitate personnel of diplomatic representations (PDRs) to equip them with adequate skills to identify and refer victims of trafficking. Furthermore, increased knowledge and understanding about the international, regional and national labour and employment legislation would also ensure full compliance of PDRs to enable better protection of migrants and vulnerable individuals from exploitation.

Core Functions / Responsibilities:

Objective of the Consultancy

The consultant will be responsible to draft and finalize a consular manual ‘Combating Human

Trafficking: What Diplomats Should Do know and Do’ which is intended to provide guidelines to PDRs and will serve as a tool in identifying cases as well as referring victims and potential victims of trafficking to relevant authorities and organizations for assistance to victims and potential victims as well as referring cases for criminal investigations. The manual will contain specific chapters related to the international and European legal frameworks and national laws Page 1 / 4of Azerbaijan, EU member states as well as other countries where Azerbaijan has diplomatic representations pertaining to the recruitment and employment of workers within the anti-trafficking framework. It will also contain information regarding roles of diplomatic officials to combat trafficking.

The specific tasks for the international consultant are the following:

1. Data collection, literature review, analysis of the concerning legislation to inform the manual. 2. Liaise with relevant partners and beneficiaries to discuss and identify the needs and priorities of the consular officials in relation to the development of the training materials; 3. Work in close coordination with IOM staff and officials of the Ministry of Foreign Affairs (MFA)and the State Migration Service (SMS), Ministry of Foreign Affairs and other relevant government agencies to develop the curriculum and training materials thereby ensuring that training materials address consular officers’ needs. The manual (texts, case studies, presentations, check list, monitoring and evaluation etc.) will be developed in English and later translated into Azerbaijan by an external translator and;

4. Upon completion of the consular manual for combating trafficking and training curriculum and materials, the international consultant will lead a multi-stakeholder training for trainers in Baku, Azerbaijan.

Expected Outputs

1. Identify and incorporate the needs and priorities of the consular officials into the training materials;

2. Ensure up-to-date and relevant information is included in the training materials. These include international and national legislations and other relevant polices.

3. Draft and finalized the consular manual on trafficking in persons and relevant training materials for Consular Officers of the Ministry of Foreign Affairs, which will provide guidelines to PDRs (policies, procedures, service levels etc.) in identifying and referring cases of human trafficking as well as providing necessary responses and;

4. Lead Training of Trainers on counter trafficking for diplomatic personnel in Azerbaijan. Timetable

Timeframe: August 2017– January 2018

Required Qualifications and Experience:

Education

• Master's degree in law, international law, migration studies, management or a related field from an accredited academic institution or a related field from an accredited academic institution with five years of relevant

professional experience; or

• University degree in the above field with seven years of relevant professional experience in Law, consular affairs, and/or development issues

Experience

• Knowledge on law preferable in international law with focus on migration; • Work experience in consular affairs with specific focus on providing services to migrant workers;

• Strong analytical and writing skills to develop counter trafficking training materials for consular officers and relevant government agencies based on international law;

• Ability and experience in liaising with government authorities as well as with international Institutions;

• Demonstrate ability to draw legislative provision and legal framework from relevant international, regional and national practices and processes and adapt them to the realities of Azerbaijan;

• Sound knowledge of international migration issues and literature;

Language

• Fluency in English is required. Working knowledge of Russian is an advantage. Note
