Background

In 2015, Burundi experienced a sharp decline in its security situation. Whilst the security situation seemed to improve in Burundi throughout 2016, the socio-political crisis has unfortunately shown no signs of abating, with little progress made in 2016 in terms of political dialogue led by the EAC (East African Community). The UN system, which includes the DPA-led mission, which stands ready, as per its mandate, to support the efforts at the regional level through national and local initiatives, continues to support this process as much as it had initially intended to.  
 
The crisis has had a severe impact on the Rule of Law and Justice Sector, the social cohesion, social fabric and the economy of the country, especially with the continued suspension of direct budget support by main donors. 
 
Furthermore, on-going tensions and conflicts between political parties at the national level have an impact on security at the community level. This general background translates into a set of concrete challenges in both the justice, security sector and peacebuilding. This results to increased potential conflicts related to displacement, return and reintegration, especially those related to access to land and property. In an already tense sociopolitical context with increased local conflicts and violence, these tensions can become obstacles to the social cohesion and peaceful reintegration. The return process risks aggravating existing tensions and causing renewed violence. 
 
Based on its experience working with the justice, peacebuilding and security institutions as well as civil society actors and responding to the current needs defined by the existing national strategies( including” la politique Sectorielle du ministère de la Justice 2016-2020”) in this area, UNDP follows a general approach that targets both the root causes and the consequences resulting from such cyclic crisis, not only at the macro-political and economic level, but at the local community level also. UNDP conducted a «Conflict Development Analysis"(CDA) exercise on its overall programme in Burundi in January 2016 and updated it in 2017. In light of this exercise, UNDP focus its interventions on rule of law and peacebuilding areas at two levels:1) the intermediate level, which targets structures that provide direct services to communities 2) and the local level that seeks to empower local communities to resolve tensions/conflicts for social cohesion. 
 
In this regard and in a close collaboration with the ministry of Justice, UNDP in Burundi interventions aims to 1) strengthen accountability and transparency mechanisms within the justice sector; 2) Develop mechanisms and tools to limit the impact of criminal justice dysfunctions on vulnerable populations; 3) improve access to justice for vulnerable population; 4) empower women victims of GBV who have followed the judicial process to reduce their vulnerability through income-generating activities;5)Strengthen social cohesion within communities through legal aid to vulnerable people and  free legal consultations by the local bar associations; 6) support spaces of dialogue in promoting community-based conflict resolution mechanisms; 7) Improve legal and material conditions of detention and promote reintegration activities for detainees.
 
The Chief Technical Specialist will play a key role in the development of technical approach of UNDP interventions in these areas and will strengthen UNDP role in differences synergies with other partners for peacebuilding consolidation in Burundi. 
 
Under the guidance and overall supervision of the Country Director in close collaboration and coordination with the Chief of Unit, Governance and Rule of Law, The Chief Technical Specialist will provide strategic advice and direction to implementations of UNDP rule of law and peacebuilding projects.
 

Duties and Responsibilities

Summary of Key Functions :
  • Provide substantive and strategic program guidance and advice in the area of Rule of Law and peacebuilding to ensure oversight, coordination and coherence in the delivery of the work-plan of the Rule of Law Projects.
  • Support Program Management with Strategic Planning, Delivery and Quality Assurance of the Strategic and Results Framework of the Rule of UNDP rule of law projects.
  • Promote Strategic Partnerships and support to resource mobilization.
  • Promotes Knowledge Management of practices and experiences.
Duties and Responsibilities :
  • Coordinate the implementation of programme areas related to Justice and the rule of law, peace building, prevention and fight against impunity of  gender-based violence ; 
  • Oversee the project implementation management functions, provide technical advice and quality assurance on the work of the implementing partners , monitoring and evaluation and report functions;
  • Coordinate the overall delivery of the projects in an effective and efficient manner; working closely with the Justice, security institutions and peacebuilding actors;
  • Provide strategic direction and leadership on the Rule of Law and peacebuilding portfolio;
  • Support the Country Office with the implementation and reporting of projects within UNDP’s RoL (Rule of Law) and peacebuilding portfolio;
  • Support the Country Office with the planning and conceptualization of project activities in the framework of targeted areas;
  • Liaise closely with colleagues at country office and technical teams;
  • Prepare periodic reports in and out of ATLAS and contribute to the preparation of other documentation as required,
  • Assist the Country Office in the development, negotiation and implementation of any additional initiatives elaborated in the context of the portfolio’s area of intervention;
  • Liaise with national counterparts and donors on project implementation;
  • Develop partnerships with the various stakeholders involved in the field of the rule of law, justice, human rights, gender and peacebuilding including regular collaboration with the Ministry of Justice, the National Commission on Human Rights. CSOs, international institutions, UN agencies;
  • Engage actively with other partners on joint planning and implementation of portfolio’s area of intervention; 
  • Provide support in developing new partnerships between UNDP and stakeholders – including national authorities, UN agencies, community leaders, community-based organizations, local and international NGOs, donor partners to support capacity building in portfolio’s area of intervention 
  • When required, ensure the representation/leadership of UNDP in inter-agency working group meetings or other coordination mechanisms on portfolio’s area of intervention 
  • Undertake any other activities as designated by the CO management as needed;
  • Liaise with implementing partners in the nine provinces of UNDP’s focus area on a regular basis and provide technical guidance as needed, and support capacity building activities with the justice system and local civil societies.
Knowledge Management and Policy Development:
  • Identify sources of information related to policy-driven issues;
  • Identify and document best practices and lessons learnt directly linked to Rule of Law and Access to Justice programming in and in particular in Burundi;
  • Contribute to UNDP global knowledge networks and communities of practice;
  • Provide intellectual and conceptual contribution in the ROL and security Knowledge Management and Learning Strategy;
  • Collaboration and coordination with other UN agencies, government agencies, NGOs, and other organizations Rule of Law and Security issues.

Partnerships and Resource Mobilization:

  • Develop and implement partnership and resource mobilization strategy in this area. Lead and coordinate resource mobilization efforts of the project. In this regard identify funding opportunities and lead project resource mobilization efforts with donor partners, including the development of advocacy/communication tools in support of resource mobilization;
  • Ensure coherence, complementarities and coordination with other development partners in the area of rule of law, access to justice and security;
  • Advocate for and substantially contribute to One UN approach and multi-partner joint planning and/or programming initiatives;
  • Build partnerships with national and international NGOs throughout the project implementation;
  • Manage, monitor and report on financial resources allocated to and delivered by the project to contributing partners such as UNDP/BCPR and Donors;
  • Maintain regular communication with UNDP/BCPR’s Rule of Law, to enhance advocacy, support resource mobilization and access technical expertise.

Required Skills and Experience

Education :
  • A Master degree in law, preferably with specialization in human rights and/or international criminal law, or related relevant field.
  • A relevant combination of university degree, professional training and experience (at least 9 years) may be considered in lieu of the advanced degree.
Experience :
  • At least 7 years’ work experience dealing with issues related to rule of law, access to justice, peacebuilding and  judicial reform in conflict and post-conflict countries or similarly relevant experience;
  • Experience in post-conflict situations, in particular, with a focus on field-work;
  • Experience in project management and resource mobilization;
  • Good knowledge on gender-based and Human Rights based approaches ;
  • Good knowledge of the Burundian context;
  • Prior experience within the United Nations, in particular UNDP, and UNDP Certification programmes Prince2 are desirable;
  • Experience in the usage of computers and office software packages, experience in handling of web based management systems.
Language :
  • Excellent oral and written skills in French, and good knowledge of English are essential.
